The Common Council of the city may in the interest of facilitating traffic enforcement authorize from time to time any changes viewed by addition or deletion to the parking provisions of this chapter by a majority vote of the Council and written directions thereafter to the Southport Chief of Police.
10.12.010 NO PARKING.
No person shall park a vehicle, except when necessary to avoid conflict with other traffic or to avoid conflict with law or the directions of a police officer or traffic-control device, in any of the following places:
(1) On a sidewalk;
(2) In front of or within five feet of a public or private driveway or alley;
(3) Within an intersection;
(4) Within 15 feet of a fire hydrant;
(5) On a crosswalk;
(6) Within 20 feet of a crosswalk at an intersection;
(7) Within 30 feet upon the approach to any flashing beacon, stop sign or traffic-control signal located at the side of a roadway;
(8) Between a safety zone and the adjacent curb or within 30 feet of points on the curb, immediately opposite the ends of a safety zone, unless the traffic authority indicates a different length by signs or markings;
(9) Within 50 feet of the nearest rail of a railroad crossing;
(10) Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of the entrance (when properly signposted);
(11) Alongside or opposite any street excavation or obstruction when such stopping, standing or parking would obstruct traffic;
(12) On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
(13) Upon any bridge or other elevated structure upon a highway or within a highway tunnel;
(14) In any alley in the city;
(15) Alongside any yellow painted curb;
(16) At any place where official signs prohibit stopping, standing or parking;
(17) Upon any area between the curb and the sidewalk.
(18) No person shall stop, stand or park a vehicle unless the right-hand wheels of such vehicle are within 12 inches of the right-hand curb of the street and highway.

10.12.020 NO PARKING ANY TIME.

Unlicensed vehicles found parked on any street or alley are declared to be a nuisance and will be impounded and towed to a storage area at owner’s expense, the person who performs the function of towing and storage shall have a possessory lien on the vehicle until payment of the cost thereof. |

10.12.030 METHOD GENERALLY.

10.12.040 NO PARKING WHERE POSTED.
No person shall stop, stand or park a vehicle upon the public streets of the city at any place where official signs or where appropriate devices, marks or painting, either upon the surface of the street or the curb immediately adjacent thereto, prohibit such acts.

10.12.050 LIMITED PARKING.
No person shall stop, stand or park a vehicle upon the public streets of the city where official signs are erected limiting the parking time thereon, for a period of time in excess of the time as designated by the official signs.

10.12.060 OTHER PARKING RESTRICTIONS.
The Common Council may order the placing of signs, or devices, or marks, or the painting of streets or curbs prohibiting or restricting the stopping, standing, or parking of vehicles on any street where, in its opinion, the stopping, standing, or parking is dangerous to those using the highway, or where the stopping, standing, or parking of vehicles would unduly interfere with the free movement of traffic thereon. The signs, devices, marks, or painting shall be official signs, devices, marks, or painting and no person shall stop, stand, or park any vehicle in violation of the restrictions thereon or as indicated thereby.

10.12.070 PARKING FOR PERSONS WITH PHYSICAL DISABILITY.
(A) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning:
PERSON WITH A PHYSICAL DISABILITY. Any person who has been issued a placard or special registration plate or decal for a motor vehicle by the State Bureau of Motor Vehicles under I.C. 9-14-5, 9-18-18, 9-18-22, or the laws of another state.
(B) Parking prohibited.
(1) It shall be unlawful for any person to park a motor vehicle, motorcycle, moped, bicycle, or other vehicle of any nature, which does not have displayed a placard for a person with a physical disability issued under the laws of this state or the laws of another state, in a parking space reserved for a vehicle of a person with a physical disability.
(2) It shall be unlawful for any person to knowingly park in a parking space reserved for a person with a physical disability while displaying a placard to which neither the person nor the person’s passenger is entitled.
(C) Violation. If any vehicle is parked unlawfully in violation of any of the provisions of this section, and the identity of the driver cannot be determined, the owner or person in whose name the vehicle is registered shall be held, prima facie, responsible for the violation.
(D) Towing. In addition to any fines which may be given as a result of violations of this section, any vehicle which is parked in a manner in violation of this section may be towed to an area designated by the city at the owner’s expense. The owner shall also be required to pay any and all storage fees resulting from this action.

10.12.080 PARKING RESTRICTIONS IN CITY PARKING LOTS.
No person shall park a vehicle or allow a vehicle to remain parked in a City parking lot between the hours of 10:00 p.m. and 6:00 a.m. In addition to any fines which may be imposed as a result of a violation of this section, vehicles may be towed at the owner’s expense by the City of Southport or its legally designated agent if found to be parked in violation of this section, which violations and vehicles shall also be subject to the provisions of Chapter 9.04 (Abandoned Vehicles); and notwithstanding any time requirements of Chapter 9.04, vehicles in violation of this section may be towed immediately. Appropriate signage giving reasonable notice of such parking restrictions shall be posted wherever such parking restrictions are to be enforced.

10.12.999 PENALTY.
Any person, firm, or corporation who violates any provision of this chapter for which another penalty is not specifically provided shall, upon conviction, be subject to a fine not exceeding $100. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
