2.12.010 Purpose.

The board of commissioners of Vanderburgh County, Indiana, now deems it to be in the best interest of the county and its citizens to afford a maximum opportunity for rehabilitation, redevelopment or economic development of areas by private enterprise and the county by establishing a department of redevelopment.

2.12.020 Established.

The board of commissioners establishes the department of redevelopment of the county. The department will be controlled by a board of five members known as the Vanderburgh County redevelopment commission.

2.12.030 Scope.

Pursuant to the Act (IC 36-7-14 and IC 36-7-25), all of the territory within the corporate boundaries of the county, except territory within any municipality in the county which has established a department of redevelopment, will be a taxing district to be known as the redevelopment district of Vanderburgh County for the purpose of levying and collecting special benefit taxes for redevelopment purposes as provided in the Act. The board of commissioners finds and determines that all of the taxable property within this special taxing district will be considered to be benefited by the redevelopment projects and economic development projects carried out under the Act to the extent of the special taxes levied under the Act.

2.12.040 Redevelopment commission.

A.    The board shall appoint, by motion, five commissioners, each of which must be at least eighteen (18) years of age and must be a resident of the county.

B.    The terms of office of the members of the Vanderburgh County Redevelopment Commission shall be for one calendar year commencing on the 1st day of January following the date of their appointment. If a vacancy should occur in the office of any member of the Vanderburgh County Redevelopment Commission then the Board of Commissioners shall fill that vacancy for a period running from the date of the vacancy through the end of the calendar year for which such vacancy is filled.

2.12.050 Redevelopment authority.

A.    The county creates a redevelopment authority under the Act to be known as the Vanderburgh County redevelopment authority (“authority”) as a separate body corporate and politic and as an instrumentality of the county.

B.    The authority is organized for the following purposes:

1.    Financing, constructing, and leasing local public improvements to the commission;

2.    Financing and constructing additional improvements to local public improvements owned by the authority and leasing them to the commission;

3.    Acquiring all or a portion of one or more local public improvements from the commission by purchase or lease and leasing these local public improvements back to the commission, with any additional improvements that may be made to them;

4.    Acquiring all or a portion of one or more local public improvements from the commission by purchase or lease to fund or refund indebtedness incurred on account of those local public improvements to enable the commission to make a savings in debt service obligations or lease rental obligations or to obtain relief from covenants that the commission considers to be unduly burdensome; and

5.    Any other purposes permitted by the Act, including the issuance of bonds to finance local public improvements.

6.    The board of directors of the authority shall be composed of three members who are residents of the county and shall be appointed by the board of commissioners for three-year terms.
