PRIVIES AND PUBLIC DRAINS

8.35.010 Prohibiting outdoor toilets.
It shall be unlawful for any person, firm or corporation to construct, keep or maintain any privy or outdoor toilet in the town of Whitestown. [Ord. 1984-05 § 10. Prior code Title 3, Art. 8, Ch. 1, § 1]
8.35.020 Violation.
Any person, firm or corporation who shall violate the provisions of WMC 8.35.010 of this chapter shall be guilty of an offense punishable by a fine of not more than $100.00. Each day’s violation shall constitute a separate offense. [Ord. 1984-05 § 10. Prior code Title 3, Art. 8, Ch. 1, § 2]
8.35.030 Nuisance.
As an additional remedy to that provided by WMC 8.35.020, it is hereby ordained that any privy or outdoor toilet constructed, kept or maintained in violation of WMC 8.35.010 be and is hereby declared to be a nuisance and that the same may be abated by proper legal or equitable proceedings which may be prosecuted by the town or by any interested person. 8.35.040 Blocking public drains prohibited – Free flow liquids.
It is hereby declared to be a nuisance for any individual, business or corporation to obstruct the free flow of liquids into or through any ditch or drain within the town limits of the town of Whitestown, Indiana, or to permit any existing obstruction to remain therein. 8.35.050 Abatement.
The town of Whitestown, Indiana, shall have full authority to order the abatement and removal of any obstruction to the free flow of liquids into or through any open ditch or drain within said town. [Ord. 1984-05 § 10. Prior code Title 3, Art. 8, Ch. 2, § 2]
