9.05.010 Definition.

Loitering or unlawful assembly shall consist of the willful standing, congregating, or assembly of one or more persons upon any of the sidewalks, streets, parks, alleys or other public places; or in, or around public or private business buildings in the town of Whitestown, Indiana, so as to disturb the peace, cause annoyance to any person, or the obstruction or hindrance of passageway for any passerby or the public attempting to make lawful use of such places. 9.05.020 Loitering unlawful.

It shall be unlawful for any person to loiter or assemble in the town of Whitestown, Boone County, Indiana, as such act or action is defined in WMC 9.05.010. [Ord. 1974-06 § 2]

9.05.030 Town duty.

It shall be the duty of the [chief of police], or any officer of the police force of the town of Whitestown to warn and order any person observed to be loitering or assembling unlawfully, as above defined, to move away and disperse from the place such acts are observed at, and any such person or persons refusing to promptly obey such warning or order shall be in violation of this chapter. 9.05.040 Violation – Penalty.

Any person who violates the provisions of this chapter shall be deemed guilty of a misdemeanor and shall upon conviction thereof be fined not more than $10.00 for each such violation to which shall be added costs of prosecution. [Ord. 1974-06 § 4]
