MOTORIZED VEHICLES ON TOWN TRAILS AND WALKING PATHS

10.45.010 Motorized vehicles are not permitted on town trails, sidewalks, and other walking paths.
Except as provided herein, no person may operate or otherwise use a motorized vehicle(s) as a means of transportation on any trail, sidewalk, or other walking path owned, operated, and/or maintained by the town including, but not limited to, those trails, sidewalks, or other walking paths owned, operated, and/or maintained by the town of Whitestown parks department. This prohibition applies to all motorized vehicles, including, but not limited to, automobiles, trucks, cars, vans, and/or nontraditional vehicles (as defined in Chapter 10.40 WMC). 10.45.020 Reasonable accommodation.
Nothing in this chapter is or shall be construed as prohibiting a person with a disability from using a motorized mobility device on a trail, sidewalk, or other walking path owned, operated, and/or maintained by the town including, but not limited to, those trails, sidewalks, or other walking paths owned, operated, and/or maintained by the town of Whitestown parks department. 10.45.030 Town motorized vehicles.
Nothing in this chapter shall prohibit the town or any town employee or official from operating a motorized vehicle on any trail, sidewalk, or other walking path owned, operated, and/or maintained by the town including, but not limited to, those trails, sidewalks, or other walking paths owned, operated, and/or maintained by the town of Whitestown parks department, as long as such operation is in connection with official town business. 10.45.040 Violations.
Any violation of this chapter is subject to the penalty provisions set forth in WMC 10.45.050. [Ord. 2015-26 § 4]
10.45.050 Penalties.
Any violation of this chapter shall be subject to a penalty according to the following schedule:
