10.25.010 Speed Limit Map.
The speed limit on the streets, alleys, and highways within the City of Gardner shall be as set forth in the City of Gardner Speed Limit Map. (Ord. 2333 § 1)
10.25.020 Marked copies of map on file.
No fewer than three copies of the City of Gardner Speed Limit Map shall be marked or stamped “Official Copy as Incorporated by Ordinance No. 2333.” A copy of the City of Gardner Speed Limit Map shall be open to inspection and available to the public at all reasonable business hours. The Department of Public Safety, Municipal Court Judge and all administrative departments of the City charged with the enforcement and establishment of speed limits shall be supplied such number of official copies of said map, similarly marked, as may be deemed necessary. 10.25.030 City Engineer – Duties.
The City Engineer shall be the official responsible for determining reasonable and safe speed limits for the streets, alleys, and highways within the City of Gardner, Kansas.
A. Whenever it is determined on the basis of an engineering and traffic investigation that any speed limit posted is greater or less than is reasonable or safe under the conditions found to exist, the City Engineer shall declare and determine a reasonable and safe speed limit and cause appropriate signs to be erected.
B. The City Engineer shall cause the City of Gardner Speed Limit Map to be amended to reflect any speed limit postings that are changed and to reflect the speed limit posted on any new streets opened within the City of Gardner.
C. The City Engineer shall provide certified and dated copies of revisions to the City of Gardner Speed Limit Map as required in GMC 10.25.020. (Ord. 2333 § 3)
10.25.040 Applicability.
This chapter does not apply to any part of the state highway system that is within the City of Gardner, Kansas. The Secretary of Transportation is empowered by K.S.A. 8-1559 to establish speed limits on the state highway system. (Ord. 2333 § 4)
10.25.050 Conflicting ordinances.
Where this chapter conflicts with any other state or federal ordinance, statute, or regulation, the most restrictive ordinance, statute, or regulation shall apply. All local ordinances, or parts of local ordinances, in conflict herewith be and the same are hereby repealed. (Ord. 2333 § 5)
