ARTICLE 6. ABUSE TO ANIMALS FORBIDDEN

2-601. INJURY PROHIBITED.

No person shall beat, ill treat, torment, overload, overwork or cause injury or unnecessary pain to any animal. (Ord. 892, Art. 6, Sec. 1)

2-602. ATTENDANCE AT ANIMAL FIGHTS PROHIBITED.

No person shall attend or solicit attendance at or be an umpire, judge, or other official at a fight staged between any animal and another animal or human. (Ord. 892, Art. 6, Sec. 3)

2-603. BUSINESS INDUCEMENT GIFTS PROHIBITED.

No person shall offer to give or give a live animal as a prize or as a business inducement or as any other form of gratuity. The offering of live animals as business inducements shall be regulated at the permitting authority’s discretion. (Ord. 892, Art. 6, Sec. 4)

2-604. MINIMUM SALE OF FOWL/POULTRY REQUIREMENT.

Chickens, ducks, birds and other poultry younger than eight weeks of age may not be sold or offered for sale in quantities of less than 25 birds to an individual purchaser. Vendors of such poultry shall provide and operate breeders or other heating devices as may be necessary to maintain the poultry in good health, and shall keep adequate food and water available to the poultry. Poultry shall not be dyed or colored or otherwise treated so as to impart to them an artificial color. (Ord. 892, Art. 6, Sec. 5)

2-605. TETHERED ANIMAL REQUIREMENTS.

No person shall leave any pet animal or livestock unattended while tethered to any utility pole, parking meter, building, structure, fence, sign, tree, shrub, bench or other object on public property or on private property without the prior permission of the person or agency in charge thereof, nor shall a pet animal be tethered in such a manner as to permit it to intrude upon a public sidewalk or street. No person shall leave any animal unattended on a balcony. (Ord. 892, Art. 6, Sec. 6)

2-605 (a) TETHERED ANIMALS TO STATIONARY OBJECTS.

It shall be unlawful for any person to tie or tether a dog or other animal to a stationary object for a period of time or in a location so as to create an unhealthy situation for the animal or a potentially dangerous situation for a pedestrian as determined by the Animal Control Officer. 2-606. DESTRUCTION OF ANIMALS PROHIBITED, EXCEPTIONS.

Except as necessary for (1) human safety; (2) relocation of nuisance animals through the use of box traps; (3) destruction of rats, mice and other pests; (4) veterinary medical practice; (5) termination of suffering; and (6) performance of official duties by public employees, it shall be unlawful to (1) deliberately injure or kill; (2) capture or trap; (3) expose a poisonous substance for; or (4) poison any animal, and further, it shall be an unlawful act to attempt any of the aforesaid unlawful acts. 2-607. RESCUE FROM VEHICLES.

Whenever any animal is found confined in a motor vehicle in a public place under weather conditions that endanger its life as determined by the director of permit authority the director of permit authority is hereby authorized, with assistance from the police which is hereby authorized, to enter such vehicle to rescue such animal and impound it in accordance with section 2-607. A prominent written notice shall be left on or in the vehicle advising that the animal has been removed under the authority of this section and impounded in accordance with 2-607 at the permit authority’s animal shelter. 2-608. ABANDONMENT PROHIBITED.

It shall be unlawful for any owner or keeper to abandon any animal. For the purpose of this section, to abandon means for the owner or keeper to leave an animal, without demonstrated or apparent intent to recover or resume custody or to leave an animal for more than 12 hours without providing for adequate food, water and shelter for the duration of the absence. 2-609. CARELESS TRANSPORTATION PROHIBITED.

No person shall carry any animal or cause any animal to be carried in or upon any vehicle in a dangerous or careless manner. For the purpose of this section, dangerous or careless shall include but not be limited to the practice of carrying dogs and other animals loose in the open bed of trucks, on top of truck cabs, hanging out of vehicle windows or roped or chained in such manner that the animal can fall or jump from the vehicle and be hung or dragged. 2-610. ARTIFICIAL STIMULATION PROHIBITED.

No person shall induce or encourage any animal in an animal exhibition, rodeo or circus to perform through the use of chemical, mechanical, electrical or manual devices in a manner which will cause or is likely to cause physical injury or suffering. (Ord. 892, Art. 6, Sec. 11)

2-611. PLACE OF SALE LIMITATIONS.

No person shall display for sale, offer for sale, exchange, barter or give away any animal except in the following places:

(a)    A commercial animal establishment, having a valid permit under this chapter.

(b)    A private kennel or cattery registered under this chapter.

(c)    A private residence.

(d)    A shelter.
