Cemetery Administration

2.45.010 Maintain cemetery trust fund.
The City Administrator or Financial Director shall continue to maintain a cemetery trust fund as part of the municipal accounting system. This fund shall be budgeted according to the provisions of this chapter as well as state law regarding municipal trust funds. The principal of said cemetery trust fund shall remain in the trust in perpetuity. [Ord. 626 § 1, 1994; 1981 Compilation § 1-3.1.]
2.45.020 Investment – Interest income.
The City Administrator or Financial Director shall be responsible for investing the fund balance commensurate with sound investment practice, whether in a separate account, CD, etc., or combined with other City funds in the state of Oregon local government investment pool. Interest generated from all bank accounts, pools, CDs, etc., will be calculated proportionately to the balances of each fund. The proportionate amount of interest attributable to the cemetery trust fund shall be deposited to the general fund to be used solely for cemetery maintenance purposes. 2.45.030 Lot sales income.
All proceeds from the sale of cemetery lots or other fees gained from the ownership or operation of the Brownsville Pioneer Cemetery shall be added to the principal of the cemetery trust fund. [Ord. 626 § 3, 1994; 1981 Compilation § 1-3.3.]
2.45.040 Donations/bequests income.
Any donations or bequests to the City of Brownsville for the purpose of maintaining the Brownsville Pioneer Cemetery shall be added to the principal of the cemetery trust fund. [Ord. 626 § 4, 1994; 1981 Compilation § 1-3.4.]
2.45.050 Rules and regulations.
The City Council will be responsible for establishing rules and regulations concerning the operation and maintenance of said cemetery. Maintenance may be provided by City personnel or by contract entered into by the City Council. [Ord. 626 § 5, 1994; 1981 Compilation § 1-3.5.]
2.45.060 Establish fees and charges.
The City Council may establish any other fees as are deemed appropriate and necessary for the continued operation and maintenance of said cemetery. All fees and charges, including the purchase price of lots, shall be set by separate resolution. [Ord. 626 § 6, 1994; 1981 Compilation § 1-3.6.]
