SPECIAL EVENTS

10.24.030 Special event permit.
10.24.010 Definitions.
As used in this chapter, except where the context indicates otherwise, the following terms shall mean:
A. "Special event" means an event or happening organized by any person which will result in members of the public congregating, either as participants or spectators, in the city for a particular and limited purpose and time, including, but not limited to, road races, fun runs, walking events, bike-a-thons, parades, festivals, carnivals, shows, exhibitions, block parties, circuses, fairs, sales and farmer’s or public markets.
B. "Person" means any person, partnership, corporation or other form of business organization.
C. "Public street" means the entire public right-of-way, including travel lanes, parking, bicycle paths and sidewalk areas. (Ord. 3038 (Exh. A)(part), 2013)
10.24.020 Permit required.
No person shall use, occupy or obstruct the free use by other persons of any public street or park for the purpose of conducting a special event without first having obtained a permit. (Ord. 3038 (Exh. A)(part), 2013)
10.24.030 Special event permit.
Application for special event permits shall be made to the city manager or designee at least twenty days prior to the intended date of the special event unless the time is waived by the city manager.
A. Form of Application. The applications shall be made on forms designated by the city manager. The application shall, at a minimum, include the following:
1. The name and address of the person responsible for the proposed event; and
2. The date of the proposed event; and
3. The starting and ending times of the proposed event; and
4. The desired location or route of the proposed event; and
5. The number of persons, vehicles, animals and structures involved in the proposed event; and
6. The dimension and plans of any temporary structures proposed to be erected for the proposed event.
B. Review of Application. The city manager or designee shall, within three working days, review the permit with the police, fire and public works departments and grant the permit if determined that the special event can be conducted without endangering public health, safety and welfare, seriously inconveniencing the general public or adversely impacting the provision of essential public services.
C. Issuance of Permit. If it is determined that the special event cannot be conducted without endangering public health, safety and welfare, seriously inconveniencing the general public or adversely impacting the provision of essential public services, the permit may be denied or issued with conditions that will eliminate or reduce the impact on the community.
D. Notice of Action on Permit. The city manager, or designee, shall notify the applicant within five working days of the filing of the application of the action taken on the permit. (Ord. 3038 (Exh. A)(part), 2013)
10.24.040 Appeal.
A decision of the city manager to issue, conditionally issue, deny or revoke a permit shall be final unless appealed in writing within five working days of the decision, by requesting a hearing before the city council. (Ord. 3038 (Exh. A)(part), 2013)
10.24.050 Prohibited conduct.
The following conduct shall constitute a violation of this chapter:
A. No person shall unreasonably interfere with a special event or participants of a special event.
B. No person shall operate a vehicle that is not part of the special event between vehicles, persons or animals participating in a special event. (Ord. 3038 (Exh. A)(part), 2013)
10.24.060 Revocation.
Any permit issued under the provisions of this chapter may be revoked by the city manager or designee when the special event is deemed to endanger public health, safety and welfare, seriously inconvenience the general public or adversely impact the provision of essential public services. 10.24.070 Severability.
Should any section or provision of this chapter or laws adopted hereby be declared unconstitutional or invalid, such decision shall not affect the validity of this chapter as a whole, or any part thereof, except that part so declared to be unconstitutional or invalid.
