10.28.010 Application of Oregon Vehicle Code to bicycles, scooters and skateboards.
A. Application of Oregon Law to Bicycles, Scooters and Skateboards. Every person operating a bicycle, scooter or skateboard upon a public roadway within the city is subject to the provisions of ORS Chapters 811 and 814 and has the same rights and duties as the driver of any other vehicle operated thereon, except:
1. Those provisions which by their very nature can have no application.
2. When otherwise specifically provided under ORS Chapters 811 and 814.
B. Definitions.
1. Subject to the provisions of subsection A of this section, a bicycle, scooter or skateboard is a vehicle, and when the term "vehicle" is used in ORS Chapter 811, it shall be deemed applicable to bicycles, scooters or skateboards.
2. Subject to the provisions of subsection A of this section, when the term "bicycle" is used in ORS Chapter 814, it shall be deemed applicable to scooters and skateboards.
3. As used in Sections 10.28.010 to 10.28.040, the phrase "bicycles, scooters, or skateboards" includes all wheeled transportation devices other than motor vehicles licensed by the Department of Motor Vehicles and those devices necessary to transport elderly or handicapped persons. 10.28.020 Operating rules.
A. No person may park a bicycle, scooter or skateboard in or near a public thoroughfare or place in such a manner as to obstruct a roadway, sidewalk, driveway or building entrance.
B. No person shall park a bicycle, scooter or skateboard in such a manner as to endanger persons or property.
C. Except as otherwise provided, a person shall not ride or operate a bicycle, scooter, skateboard, or any motorized vehicle or transportation device upon a public sidewalk within the downtown commercial district consisting of the area between and including the south side of Washington Avenue to the north side of Whiteaker Avenue and between and including the east side of 9th Street (Highway 99) to the east bank of the Coast Fork Willamette River. This subsection does not apply to self-propelled or motorized devices that are medically necessary for the mobility of the person.
D. This section shall not apply to peace officers, police community service officers, maintenance workers and police/public works volunteers performing official duties. (Ord. 3128 §1(part), 2020)
10.28.030 Registration.
The police department may provide a registration service for the purpose of returning lost or stolen bicycles, scooters or skateboards. (Ord. 3128 §1(part), 2020)
10.28.040 Impounding of bicycles, scooters and skateboards.
A. A bicycle, scooter or skateboard left on public property for a period in excess of twenty-four hours may be impounded by the police department.
B. In addition to any citation issued, a bicycle, scooter or skateboard parked or used in violation of this chapter may be immediately impounded by the police department.
C. If a bicycle, scooter or skateboard impounded under this chapter is registered, or other means of determining its ownership exists, the police department shall make reasonable efforts to notify the owner.
D. A bicycle, scooter, or skateboard impounded under this chapter which remains unclaimed shall be disposed of in accordance with the city’s procedure for disposal of abandoned or lost personal property. (Ord. 3128 §1(part), 2020)
