SKATEBOARDS AND SCOOTERS

10.16.010 Definitions.
“Scooter” means a vehicle for riding on, consisting of a low, narrow footboard with a wheel or wheels at each end, and a raised handlebar for steering; it is moved by a series of pushes made by one foot against the ground.
“Skateboard” means a board of any material, natural or synthetic, with wheels affixed to the underside, designed to be ridden by a person. [Ord. JU/OF-88-1 § 1, 1988].
10.16.020 Duty to yield.
A person riding a skateboard or scooter shall yield the right-of-way to pedestrians, and shall yield the right-of-way to motor vehicles when approaching or crossing a driveway or street intersection. [Ord. JU/OF-88-1 § 2, 1988].
10.16.030 Duty to obey traffic control signs and devices.
A person riding a skateboard or scooter upon a public street shall obey all traffic control signs and devices. [Ord. JU/OF-88-1 § 3, 1988].
10.16.040 Prohibited riding times.
No person shall ride a skateboard or scooter upon any street or sidewalk at any time from sunset to sunrise or at any time when, due to insufficient light or inclement weather conditions, persons or vehicles are not clearly discernible at a distance of 1,000 feet. [Ord. JU/OF-88-1 § 4, 1988].
10.16.050 Careless riding.
No person shall ride a skateboard or scooter upon a roadway, sidewalk, or premises open to the public in a manner that endangers or would be likely to endanger any person or property. [Ord. JU/OF-88-1 § 5, 1988].
10.16.060 Prohibited riding areas.
The city council may from time to time establish areas where the use of skateboards or scooters are prohibited, including sidewalks in such areas. Such action shall be taken by motion which designates that area and directs posting of signs in the area, notifying of the prohibition. The prohibition shall be complete upon the posting of such notices. [Ord. JU/OF-88-1 § 6, 1988].
10.16.070 Seizure of skateboards and scooters.
A. At such time as a skateboard or scooter rider is in violation of this chapter, the police may seize the skateboard or scooter upon which the violator was riding.
B. A skateboard or scooter may be recovered from the Eagle Point police department between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday, by an adult rider 24 hours after being seized.
C. A skateboard or scooter may be recovered from the Eagle Point police department between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday, by a juvenile offender 24 hours after being seized. However, a board or scooter shall not be released to a juvenile offender unless he or she is accompanied by a parent or guardian. [Ord. JU/OF-88-1 § 7, 1988].
10.16.080 Procedure.
A citation to appear in Eagle Point municipal court for violation of this chapter may be issued to the alleged violator stating the date, time and place to appear, and the date and place of the alleged offense. At the request of the offender, a trial shall be conducted before the municipal court judge. [Ord. JU/OF-88-1 § 8, 1988].
10.16.090 Penalty.
The penalty for violation of any provision of this chapter shall be a fine of not less than $8.00 and not more than $100.00. [Ord. JU/OF-88-1 § 9, 1988].
10.16.100 Revocation of use.
If the city council finds there have been repeated violations of this chapter, it may from time to time revoke the use of all skateboards or scooters within the city limits for a specified period of time. This shall be done by a motion and one publication of notice in a newspaper of general circulation within the city. This notice shall include the starting and ending dates of the revocation period.
