ANIMAL CONTROL*

6.05.010 Enforcement of county ordinance.
In accordance with the provisions of ORS 190.010 and 203.040, the city of Fairview does hereby authorize Multnomah County, its agents and representatives, to enforce within the city limits of Fairview, Multnomah County Ordinance No. 732, dated September 3, 1992. (Ord. 8-1993 § 1)
6.05.020 Ordinance Nos. 3-1954 and 3-1967 suspended.
The city council does hereby further direct that during such time as the application and enforcement of said Multnomah County Animal Control Ordinance (Ordinance No. 732 as amended to date) is authorized within the city limits of Fairview, that the provisions of Fairview Ordinance No. 3-1954, as amended by Ordinance No. 3-1967, and, except as set forth in FMC 6.05.040, other city ordinances and regulations dealing with the licensing, regulation and/or control of dogs, exotic, wild or dangerous animals or livestock, which may be in conflict with the said Multnomah County Animal Control Ordinance, are hereby suspended and shall not be in force unless and until such time as this city shall terminate its agreement and understanding with Multnomah County as hereinabove set forth. 6.05.030 City to furnish information.
The appropriate departments of the city are hereby authorized to furnish to Multnomah County such information as may be pertinent to the application and enforcement of Multnomah County Animal Control Ordinance MCC 8.10 within Fairview to assure that optimum control and regulation of the various animals concerned therein is maintained so as to promote the maintenance of the peace, health, safety and welfare of the residents and inhabitants of the city and the protection of properties located therein. 6.05.040 Keeping of roosters.
Notwithstanding the definition of nuisance in FMC 8.10.020, keeping or maintaining roosters within the city limits of Fairview shall be a nuisance and shall be abated in accordance with the procedures set forth in Chapter 8.10 FMC. (Ord. 4-2010 § 1)
