2.25.010 Chief of police – Authority.
The chief of police shall be the conservator of the peace and, in addition to the authority vested in him by the ordinances of the city of Garibaldi, shall have authority and jurisdiction of a constable within the city limits and shall discharge the same according to the statutes of the state. He shall arrest with or without a warrant all persons guilty of a breach of the peace or violation of any city ordinance and take them before the municipal judge for trial. [Ord. 78 § 1, 1972.]
2.25.020 Chief of police – Duties.
The chief of police shall be the keeper of the city jail and shall have custody of all persons incarcerated therein. He shall keep such records and make such reports concerning the activities of his department as may be required by statute or by the city council. The chief shall be responsible for the performance by the police department of its functions and all persons who are members of the police department or a police reserve shall serve subject to the orders of the chief of police. 2.25.030 Duties.
It shall be the duty of every member of the police department to conduct himself or herself in a proper and law-abiding manner at all times and to avoid the use of unnecessary force. Each member of the department shall obey the orders and directions of his superior. [Ord. 78 § 3, 1972.]
2.25.040 Appearing as witness.
Every member of the police department shall appear as a witness wherever this is necessary in a prosecution or violation of an ordinance or of any state or federal law. No such member shall retain any witness fee for service as witness in any action or suit to which the city is a party; any fee paid for such service shall be turned over to the city recorder. 2.25.050 Rules and regulations.
The chief of the police department shall make or prescribe such rules and regulations as he shall deem advisable; such rules, when approved by the city council, shall be binding upon such members. Such rules and regulations may cover, besides the conduct of the members, uniforms and equipment to be worn or carried, hours of service, vacations and all other similar matters necessary or desirable for better efficiency of the department. 2.25.060 Appointment.
The chief of police and any subordinate police officers serving the city for compensation shall be appointed by the mayor with approval of the city council. In the absence of a written employment contract with any such person hired, it shall be presumed that all hiring shall be on a month-to-month basis and may be terminated at any time by action of the city council. 2.25.070 Reserve police force – Organization – Approval.
The chief of police, in his discretion, may organize and recruit a reserve auxiliary police force for the city of Garibaldi upon obtaining consent thereto from the city council. To obtain such approval, the chief shall present to the city council a written plan stating, but not limited to, the following facts:
A. Number of persons to be on the force.
B. Hours and type of duties.
C. A training program. [Ord. 78 § 7, 1972.]
2.25.080 Reserve police force – Requirements.
Any person serving in the reserve police force must be a resident of the city of Garibaldi and shall serve without compensation. Any applicant selected for service shall take and subscribe to the oath of office required of employees of the city of Garibaldi and shall be subject to the direction and orders of the chief of police and shall, during such service, have the powers and duties of a regular police officer of the city of Garibaldi. 2.25.090 Approval – Sworn in.
All applicants shall be approved by the city council prior to the acceptance of that application and shall be sworn in by the city recorder. [Ord. 78 § 9, 1972.]
2.25.100 Contract with sheriff.
In lieu of any of the applicable provisions of GMC 2.25.010 through 2.25.090, the city council may elect to have the police functions of the city of Garibaldi performed by the office of the sheriff of Tillamook County. Any such arrangement shall be by written contract, each such contract to have an effective life of not more than five years; provided, that such contracts may be renewed for additional periods of up to five years by action of the city council.
