10.10.010 Overtime parking.

Where maximum parking limits either on city streets or in city parking lots are designated by a sign placed by the city of Garibaldi, it shall be a violation of this chapter to park longer than the designated time in that parking space. [Ord. 257 § 1, 2002.]

10.10.020 Penalties.

Violation of GMC 10.10.010 shall be punishable by a fine not to exceed $20.00. [Ord. 257 § 2, 2002.]

10.10.030 Citations on illegally parked vehicles.

A. Whenever a vehicle without an operator is found parked in violation of a restriction imposed by this chapter, the officer finding the vehicle shall take its license number, and other information displayed on the vehicle which may identify its owner, and shall conspicuously affix to the vehicle a parking citation. The parking citation shall instruct the owner to pay the penalty imposed or contest the citation within 10 days of the date the citation was issued. The citation shall specify how to contest the citation or pay the penalty, and shall clearly explain the consequences for failing to do so within the required time period. A copy of the citation shall be mailed to the registered owner of the vehicle.

B. The parking citation will serve as the means of notifying the owner of the vehicle that, if any person fails to respond to the citation or fails to pay all outstanding penalties for three or more parking citations within 10 days from the date the last citation was issued, the vehicle may be towed and impounded.

C. If the vehicle remains in the same space after the issuance of a parking citation, a subsequent violation occurs if the vehicle remains in the same space after the issuance of a citation for a period which exceeds the time designated as the parking time limitation for the space. 10.10.040 Failure to comply with citations.

If an owner does not respond to a parking citation issued pursuant to GMC 10.10.030 within the required time period, the amount of the penalty specified in the parking citation shall double. When a vehicle is found in violation of this chapter and the owner of that vehicle has three or more unpaid parking citations, then upon issuing the fourth citation an officer shall, in addition to issuing a citation, order the vehicle to be towed and impounded. After a vehicle has been impounded pursuant to this section, the “post-towing” notice set forth in GMC 8.20.070 shall be given to the owner of the vehicle. The owner may request a hearing pursuant to GMC 8.20.070 and 8.20.080. The hearing shall be limited to circumstances surrounding the towing and impound of the vehicle and shall not be a hearing to contest parking citations. A vehicle impounded under this section may be released to a licensed driver upon presentation of proof of ownership, registration and insurance, and payment of all outstanding parking citations and of the city administrative fees applicable to the impounding of vehicles. 10.10.050 Waiver of penalties.

The penalties relating to overtime parking may be waived in advance by motion of the Garibaldi city council at a regular council meeting for an event that brings additional persons to the downtown area who are unable to adhere to the time limits without disruption to the special event, or for special event sales designed to encourage customers to shop in the downtown area by merchants' committees or Chamber of Commerce campaigns or events. Requests for waivers under this section must be made in writing with enough advance notice to allow for discussion at a regular city council meeting, and must include the sponsoring agency name, contact person, date of activity, reason the waiver is requested and the estimated number of individuals expected to attend. 10.10.060 Parking permits.

The owners, operators, agents and employees working for or associated with businesses or organizations whose place of business is in the downtown area are subject to the parking restrictions of this chapter; provided, that the council may, by resolution, provide for the issuance of parking permits authorizing owners, operators, agents or employees above to park in city-owned parking lots without reference to the time limits specified in GMC 10.10.010 upon payment of an annual fee to the city.
