CURFEW

5.10.010 Curfew imposed.
No minor under 18 years of age shall be on a street, highway, park, alley or other public place between the hours specified in HMC 5.10.020, unless:
(1) The minor is accompanied by a parent, guardian or other person 21 years of age or over and authorized by the parent or by law to have custody of the minor;
(2) The minor is actually engaged in traveling upon a street, highway, park, alley or other public place to and from a place of employment, school class, religious meeting, recreational activity, or while upon an errand of mercy or emergency under direction of his parent or guardian or other adult person having the immediate care, custody, or control of such child; or
(3) The minor is emancipated under ORS 419B.550 to 419B.558. [Ord. 373 § 1, 2005.]
5.10.020 Curfew hours.
For the purposes of this chapter, the applicable hours of curfew are:
(1) On Sunday through Thursday, between 10:00 p.m. and 5:30 a.m. of the following morning.
(2) On Friday and Saturday, between 11:00 p.m. and 5:30 a.m. of the following morning. [Ord. 373 § 2, 2005.]
5.10.030 Parental responsibility.
No parent, guardian or other person having legal custody of a minor under the age of 18 years shall permit the minor to be in violation of this chapter. [Ord. 373 § 3, 2005.]
5.10.040 Police custody.
Any police officer is authorized to take a minor violating a provision of this chapter into custody as provided by ORS 419C.080, 419C.085 and 419C.088. [Ord. 373 § 4, 2005.]
5.10.050 Refusal of parent or guardian to take custody.
No parent, guardian, or other person having legal custody of a minor taken into police custody as provided in HMC 5.10.040 shall refuse to come immediately and take custody of the minor upon being notified to do so by the police. [Ord. 373 § 5, 2005.]
5.10.060 Penalty.
Violation of a provision of this chapter is punishable by a fine not to exceed $100.00. [Ord. 373 § 6, 2005.]
