10.20.010 Definitions.

“Animal” means any animal other than a human being.

“Direct physical control” means control by means of a leash, harness or other restraining device held by the owner or caretaker and leading to the animal.

“Facilities or workspace” means any building, site, or vehicle comprising the operations of the city, including, but not limited to: City Hall, public works shop, wastewater treatment plant, and library. City-owned parks, open spaces, and vacant land are excluded from this definition.

“Indirect physical control” means control of the animal by voice or hand signals or other effective control.

“Owner or handler” means the person the animal or pet is accompanying.

“Service animal” means a dog or miniature horse that is individually trained to do work or perform task(s) for a person with a disability. Other species of animals, whether wild or domestic, trained or untrained, are not service animals as defined by the ADA and ORS. The work or tasks performed by the service animal must be directly related to the individual’s disability. [Ord. 426 § 4, 2018; Ord. 415 § 1, 2016. Formerly § 5.45.010.]

10.20.020 Regulations.

Pets and other animals are not allowed in city facilities and vehicles except for service animals. Except as provided below in HMC 10.20.030, service animals are permitted in all city facilities. [Ord. 426 § 4, 2018; Ord. 415 § 2, 2016. Formerly § 5.45.020.]

10.20.030 Exceptions.

(1) Service animals must be under control. Service animals must be harnessed, leashed, or tethered unless these devices interfere with the service animal’s work or the individual’s disability prevents using these devices. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls.

10.20.040 Enforcement.

Upon observing an animal on the premises, city staff are allowed to ask (1) if the dog or miniature horse is a service animal that is required because of a disability, and (2) what work or task the service animal has been trained to perform. If the animal is not a service animal, if the service animal is not under the control of the owner or handler, or if the service animal is not housebroken, city staff are authorized to ask the owner or handler to remove the animal from the premises.
