3.24.010 Purpose.

The purpose of the percent for art program is to expand the experience of the city’s residents and visitors through public art of the highest quality in concept and execution. This will improve the quality of life in the city by allowing residents and visitors to view and interact with public art regularly in public spaces. It will instill a concern for beauty and good design in both the public and private sectors by setting high aesthetic standards. It will reflect and communicate the history, character, and values of the community and thereby create a sense of place. (Ord. 2004-14 § 1)

3.24.020 Definitions.

Except where the context requires otherwise, the words used in this chapter shall have the following meanings:

“Acquisition” means acquiring, siting, and maintenance or any one or more thereof.

“City facility” means any city building, developed park area, or structure including but not limited to office buildings, sports facilities, utility and transportation infrastructure, and service facilities.

“Construction cost” means the cost of construction, excluding costs of engineering, administration, and fees and permits, and excluding indirect costs including but not limited to interest during construction, advertising costs, and legal fees.

“Major construction project” means any city facility capital improvement project the cost of which exceeds $50,000 that is paid for in whole or in part by the city, including but not limited to purchase, construction, rehabilitation, renovation, remodeling, or improvement of city facilities. It does not include projects designated by the city council as emergency projects and does not include ordinary maintenance and repair projects, including but not limited to street overlay projects.

“Responsible department” means the city department the budget of which includes a major construction project.

“Works of art” means all forms of original creations of visual art appropriate for viewing by persons of all ages including, but not limited to:

1. Painting in any medium, including both portable and permanently fixed works such as murals;

2. Sculpture, in the round, bas-relief, mobile, fountain, kinetic, electronic, and other forms, and in any material or combination of materials;

3. Other visual media including but not limited to prints, drawings, stained glass, calligraphy, glass works, mosaics, photography, film, clay, fiber textiles, wood, metals, plastics, or other materials or combinations of materials, or crafts or artifacts;

4. Works of a wide range of materials, disciplines, and media that are of specific duration, including performance events, that are documented for public accessibility after the period of specific duration has ended. Works of art may have functional as well as aesthetic qualities. (Ord. 2004-14 § 1)

3.24.030 Percent for art requirement.

One-half percent of the construction of each major construction project shall be used for the acquisition of a work or works of art to be owned by the city and to be displayed in an area or areas frequently visited by the public within the city limits, whether or not such area or areas are at the site of the major construction project. (Ord. 2004-14 § 1)

3.24.040 Phased projects.

Unless otherwise decided by the city council, if a major construction project will be constructed in phases, then at the time of construction of each phase one-half percent of the construction cost of that phase shall be used for the acquisition of works of art pursuant to LCMC 3.24.030. The city council, however, in its discretion may decide to set aside all or part of the half-percent for a project phase or phases so that the half-percent for the entire project may be used in a coordinated, rather than in a piecemeal, fashion. 3.24.050 Waiver.

The city council, in its discretion, may waive in whole or in part the percent for art requirement of LCMC 3.24.030. (Ord. 2004-14 § 1)
