OFFENSES BY OR AGAINST MINORS

9.16.010 Leaving child unattended in vehicle.

A. No person having the care and custody of a child six years of age or younger shall knowingly leave, lock or confine the child for more than 15 minutes in a motor vehicle on the streets, alleys, public ways or public places of the city. A child is unattended, within the meaning of this section, if the oldest person with the child is not 10 years of age or older.

B. It is lawful and the duty of a police officer or other peace officer finding a child, as defined in subsection (A) of this section, unattended in a motor vehicle in violation of said subsection (A) to enter the vehicle and remove the child, using such force as is reasonably necessary, and if deemed necessary by the officer to effect an entrance to the vehicle where the child is confined in order to remove the child.

C. Leaving a child unattended in a vehicle is a Class A misdemeanor. (Ord. 88-7 § 7.10)

9.16.020 Places of amusement.

A. No person under 18 years of age shall enter, visit or loiter in or about a public cardroom, poolroom, billiard parlor or dance hall, unless the establishment is a recreational facility as defined in this section.

B. No person operating or assisting in the operation of a public cardroom, poolroom, billiard parlor or public place of amusement shall permit a person under 18 years of age to engage therein in any game of cards, pool, billiards, dice, darts, pinball, games of like character, or games of chance either for amusement or otherwise.

C. No person shall employ a person under 18 years of age in or about a cardroom, poolroom, billiard parlor or dance hall, unless the establishment is a recreational facility as defined in this section.

D. These prohibitions do not apply to the playing of billiards or pool in a recreational facility. As used in this chapter, a “recreational facility” means an area, enclosure or room in which facilities are offered to the public to play billiards or pool for amusement only and:

1. Which is clean, adequately supervised, and adequately lighted and ventilated;

2. In which no alcoholic liquor is sold or consumed; and

3. Access to which does not require passing through a room where alcoholic liquor is sold or consumed.

E. Violation of this section is punishable as a Class A misdemeanor. (Ord. 88-7 § 7.20)

9.16.030 Misrepresentation of age by minor.

A. No person shall:

1. Being less than a certain specified age, knowingly represent himself to be of any age other than his true age with the intent of securing a right, benefit or privilege which by law is denied to persons under that certain specified age;

2. Being unmarried, knowingly represent that he is married with the intent of securing a right, benefit or privilege which by law is denied to unmarried persons.

B. Violation of this section is punishable as a Class B misdemeanor. (Ord. 88-7 § 7.30)
