CURFEW

9.32.010 Curfew imposed.
No minor under 18 years of age shall be on a street, highway, park, sidewalk, alley or other public place between the hours specified in LCMC 9.32.020, unless:
A. The minor is accompanied by a parent, guardian or other person 21 years of age or over and authorized by the parent or by law to have custody of the minor;
B. The minor is engaged in travelling to or from a place of employment, or a school-sanctioned activity;
C. The minor is emancipated under the provisions of ORS Chapter 109. (Ord. 93-18 § 2)
9.32.020 Curfew hours.
For the purposes of this code, the applicable hours of curfew are:
A. For minors 16 and 17 years of age, the curfew is between 12:00 a.m. and 5:00 a.m. on any days for which no school is scheduled;
B. For minors 16 and 17 years of age on any day immediately preceding a day for which public school is scheduled, and for minors less than 16 years of age on all nights, the applicable hours of curfew are the hours between 10:00 p.m. and 5:00 a.m. of the following morning. (Ord. 93-18 § 2)
9.32.030 Parental responsibility.
No parent, guardian or other person having legal custody of a minor under the age of 18 years shall permit the minor to be in violation of this chapter. (Ord. 93-18 § 2)
9.32.040 Police custody.
Any police officer is authorized to take a minor violating a provision of this chapter into custody in accordance with the provisions of ORS Chapter 419. (Ord. 93-18 § 2)
9.32.050 Refusal of parent or guardian to take custody.
No parent, guardian, or other person having legal custody of a minor taken into police custody as provided in LCMC 9.32.040 shall refuse to come immediately and take custody of the minor upon being notified to do so by the police. (Ord. 93-18 § 2)
9.32.060 Violation – Penalty.
Any violation of LCMC 9.32.030 or 9.32.050 is punishable as a Class D violation, pursuant to Chapter 1.16 LCMC, for a first violation. A second violation within a calendar year is punishable as a Class C violation. A third violation within a calendar year is punishable as a Class B violation. A fourth and any subsequent violations within a calendar year are punishable as Class B violations pursuant to the Lincoln City Municipal Code. (Ord. 2015-10 §§ 5, 6; Ord. 93-18 § 2)
