2.15.010 Creation of planning commission.
There is hereby created a planning commission (hereinafter referred to as the commission) for the city of Myrtle Creek, Oregon. [Ord. 324 § 1, 1967].
2.15.020 Membership of commission.
The commission shall consist of five members to be appointed by the city council, not more than one of whom may be nonresidents of the city of Myrtle Creek, but who shall be residents of the urban growth area. Commission members shall receive no compensation, but shall be reimbursed for duly authorized expenses. No more than two members may engage principally in the buying, selling or developing of real estate for profit. No more than two members shall be engaged in the same kind of occupation, business, trade or profession. [Ord. 09-005, 2009; Ord. 324 § 2, 1967].
2.15.030 Term of office.
Except for appointments to fill an unexpired term, all members of the commission shall be appointed for a term of four years each. Each member shall be assigned to one of five positions which shall be numbered Position 1 through Position 5. Members serving on the commission on the effective date of the ordinance codified in this chapter shall continue in the position to which they were assigned when appointed to the commission. A member of the commission may be removed by the city council, after hearing, for misconduct or nonperformance of duty. Any vacancy shall be filled by the city council for the unexpired portion of the term. [Ord. 09-005, 2009; Ord. 324 § 3, 1967].
2.15.040 Election of officers.
The commission, at its first meeting of each new year, shall elect a chairman and vice-chairman, who shall be voting members and who shall hold office during the pleasure of the commission. [Ord. 324 § 4, 1967].
2.15.050 Financial interests and participation limitations.
A member of the commission shall not participate in any commission proceedings or action in which any of the following has a direct or substantial financial interest:
The member or the spouse, brother, sister, child, parent, father-in-law, mother-in-law of the member, any business in which the member is then serving or has served within the previous two years, or any business with which the member is negotiating for or has an arrangement or understanding concerning prospective partnership or employment.
Any actual or potential interest shall be disclosed at the meeting of the commission where the action is being taken. [Ord. 324 § 5, 1967].
2.15.060 Schedule of meetings and quorum.
All meetings of the planning commission shall be public and shall be scheduled and conducted in accordance with state statutes relating to public meetings. Three members of the commission shall constitute a quorum. The commission may make and alter rules and regulations for its governance and procedures consistent with laws of this state and with the City Charter and ordinances. Special meetings may be called at any time by notice served upon each member of the commission at least 24 hours before the time specified for the proposed meeting. 2.15.070 Powers and duties.
The commission shall have all the powers which are now or hereafter granted to it by ordinances of the city or by general laws of the state of Oregon. [Ord. 324 § 7, 1967].
2.15.080 Recommendations to city council.
All recommendations and suggestions made to the city council by the planning commission shall be in writing. [Ord. 324 § 8, 1967].
2.15.090 Expenditures.
The commission shall have no authority to make expenditures on behalf of the city, or to obligate the city for the payment of any sums of money, except as the same may be authorized by the city council or pursuant to budget appropriations and pursuant to administrative methods by which said funds shall be drawn and expended.
