10.24.010 Truck routes--Designated.

Highway 99, First Street, C Street, East Bolz Road, Fern Valley Road, Fourth Street and Maple Street are designated as truck routes in the city and motor vehicles having a licensed grossed vehicle weight of over twenty thousand pounds for one vehicle or thirty thousand pounds for a combination of vehicles, shall not travel or be parked upon any other streets in the city except as set forth in this chapter.

10.24.020 Exceptions.

A.    Exception to Section 10.24.010 are where trucks are using other streets for the following purposes: Going to or from a residence, school, church or Norton Lumber Company for the purpose of picking up a load or making a delivery.

B.    This exception applies only where the truck uses the shortest route from the truck route.

10.24.030 Responsibility.

It shall be rebuttably presumed that the registered owner of any vehicle parking violation of these regulations, was parked by such a registered owner.

10.24.040 Violation--Infraction.

Any person who parks a vehicle or uses an improper route in violation of this chapter is guilty of an infraction.

10.24.050 Violation--Penalty.

A person who commits an infraction by violating designated provisions of this code shall not suffer any disability of legal disadvantage based upon conviction of a crime. The penalty for committing an infraction shall be a fine not to exceed two hundred dollars; however, each and every day during any portion of which any infraction is committed, continued or permitted by any such person, is a separate violation subject to a separate fine of two hundred dollars, and such person shall be punished accordingly and in the discretion of the judge. The city shall have the burden of proving the infraction by a preponderance of a the evidence and the defendant may not be required to be a witness at the trial of such infraction. At any trial involving an infraction, the city attorney shall not appear unless the defendant is represented by an attorney. Further, at any such trial, defense counsel shall not be provided for at public expense.
