13.04.010 System authorized.

A.    The city is authorized to purchase the necessary material, equipment, land and water rights therefor and to construct a water plant and system in and for the city for the purpose of providing water for the use of the inhabitants thereof, as follows:

1.    The system shall be a gravity system consisting of a dam and reservoir of suitable size to be constructed on the southeast one-quarter of the northeast one-quarter of Section 20 in Township 38, Range 1 west of the Willamette Meridian in Oregon and the water supply for the system shall be taken from Coleman Creek and the council is authorized and directed to purchase, on such terms as may seem proper to it, the tract of land and such water rights on Coleman Creek as it may deem suitable.

2.    From the reservoir on the land an eight-inch pipeline shall be constructed to the city, such pipeline to be twelve thousand feet more or less in length.

B.    As a part of the water system the city council is further authorized to lay and construct in and along such of the streets and public highways of the city as it may deem advisable distributing water mains of such size as it may consider proper.

13.04.020 Connection--Water meter installation fee.

Before any property is connected to the water system of the city of Phoenix, the property owner shall pay to the city for the installation of the water meter fees as set forth in the water service connection fee schedule, actual costs of materials, labor and equipment plus ten percent. When two service connections can be installed in the same trench, the cost of the second connection is to be tap and materials only plus ten percent if subdivision pricing does not apply.

13.04.030 Connection--Subdivider charges.

In a subdivision where the developer engineer stakes the service locates and the grades of each service and where not less than eight services can be installed at one time and the subdivider’s contractor performs the excavation and backfill, the charge to the subdivider shall be actual cost of material, labor and equipment plus ten percent and four dollars forty-six cents per foot of service.

13.04.040 Water meter--Change of meter size and other related water connection projects.

Where services change from one meter size to another, the property owner shall pay to the city water connection fees as set forth in the water service connection fee schedule. For all other water service connection projects, the property owner shall pay the cost of materials, labor and equipment plus ten percent.

13.04.050 Water meter--Repair or replacement.

The repair, replacement and maintenance of water meters two inches in size or above shall be accomplished as follows:

A.    The meter will be removed and replaced by the city utility crew;

B.    The repair, replacement or maintenance as the case may be of the water meter shall be by or under the direction of the city utility department unless within forty-eight hours of the time such repair, replacement or maintenance becomes necessary, the owner of the subject property indicates in writing that he or she wishes to have the repair, replacement or maintenance done by a manufacturer’s repair agency which is approved by the city.

C.    Whether the repair is done by the city or under the direction of the owner of the property, all costs incident to the repair, replacement or maintenance shall be the cost of the owner of the property.

D.    During the time the meter is being repaired the water billing will be based on the per diem usage for the property during the same period for the preceding year and if the property was not in use during the preceding year, then it shall be based upon the actual water used during the preceding month.

13.04.060 Billing.

Water bills are due on or before thirty days after issue; a second notice is then sent giving notice of date water will be shut off for delinquency. If not paid by the shut-off date on the second notice, then such water service shall be disconnected and shall remain disconnected until the water service charge is paid in full. However, such time period may be extended if hardship or extenuating circumstances are shown to the city recorder or city council.

Effective March 7, 2008, a fee of seven dollars and fifty cents shall be assessed against any city utility account when a shut-off notice is sent, to cover the production and mailing of said notice. The late fee shall be added to and become part of the outstanding balance against the account, and shall bear interest at the same rate as the outstanding balance.

13.04.070 Connection deposit.

Before water service shall be connected to new connections in the future there shall be deposited with the city the sum of twenty-five dollars to be applied toward the closing water bill; however, such deposit shall not prevent the water service from being disconnected as set forth in Section 13.04.060.

13.04.080 Disconnection--Reconnection fee.

After water service has been disconnected, as provided in Section 13.04.060, there shall be paid to the city a fee of forty dollars if the water service is reconnected between four p.m. and eight-thirty a.m. or on Saturday, Sunday or holidays and a fee of twenty dollars if the water service is reconnected during regular hours.

13.04.090 Damage to meter--Expense.

Any damage done to a water meter by reason of its being turned on or off by someone other than a city employee shall be at the expense of the occupant of the property.

13.04.100 Deposit of funds.

Effective as of March 1, 1981, the amount of two hundred dollars per month received for water services shall be applied to the city water reservoir fund. All charges over the basic bimonthly charges shall be placed in the utility fund.

13.04.110 Water pressure standards.

A.    Standard No. 1. Residences with less than thirty-five pounds per square inch static pressure at their meter connection and with service lines less than one inch nominal diameter from the main to the meter:

1.    The city will, as funds are available, replace the service lines from the main to the meter with 1 inch nominal diameter service line.

2.    The responsibility of undersized residential service lines from the meter to points of use on private property shall remain the responsibility of the property owner.

B.    Standard No. 2. Residences presently with one inch nominal diameter service lines from the main to the meter with less than thirty-five pounds per square inch static pressure at their water meter connection shall install at their own expense, if they so choose, booster pumps with low pressure cutoff switches and approved cross connection control devices.

C.    Standard No. 3. All new service lines installed from the main to the meter shall be a minimum of one inch nominal diameter.

13.04.120 Water curtailment plan.

The city adopts, by reference, the following listed plan so that it will be the law in the city to the same extent as though it was set forth verbatim herein: city of Phoenix water curtailment plan (2003 Revision).
