OUTDOOR DANCES

94.01 PERMIT REQUIRED.

No person shall operate an outdoor dance without first obtaining a permit from the Chief of Police.

94.02 PERMIT APPROVAL.

(A) The Chief of Police shall issue the permit if the Chief finds the following.

(1) The proposed dance will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation.

(2) The conduct of the dance will not substantially interrupt the safe and orderly movement of traffic.

(3) The conduct of the dance will not require the diversion of so great a number of police officers to properly police the activity and the contiguous areas as to prevent normal police protection to the city.

(4) The conduct of the activity is not reasonably likely to cause injury to persons or property or incite violence, crime or disorderly conduct.

(5) The proposed use of a park or park facility will not unreasonably interfere with or detract from the general public enjoyment of the park.

(B) The Chief may impose conditions on the permit necessary to ensure compliance with this section.

94.03 PERMIT INFORMATION.

A permit shall contain the following information.

(A) Date of the dance.

(B) Location of the dance, including, if applicable, restrictions to certain areas of the park.

(C) Hours when the dance will start and terminate.

(D) Special conditions imposed on the dance.

94.04 INSPECTION.

The Chief of Police and city police officers may go upon the premises or facilities for which the permit has been granted for the purpose of inspection and enforcement of this subchapter and state law.

94.05 PERMIT DENIAL OR REVOCATION; APPEALS.

(A) An applicant whose permit has been denied or revoked shall be given notice of the denial and revocation that contains the reason for the denial or revocation.

(B) A permit denial or revocation may be appealed to the Council by filing notice of the appeal with the City Manager.

94.99 PENALTY.

Violation of a provision of § 94.01 is punishable by a fine not to exceed $100.
