5.20.010 License required – Nuisance declared.
The practice of itinerant merchants, transient vendors of merchandise, or traveling sellers of merchandise holding, promoting, or operating auctions at temporary locations in the city of Rainier, without having first obtained a license so to do from the recorder of the city of Rainier as herein provided, is hereby declared to be a nuisance, and punishable as a misdemeanor. 5.20.020 Requirements for license.
The city recorder is hereby authorized and directed to issue a license to do business in the city of Rainier to those persons desiring to promote, operate, or hold an auction who shall satisfy the following requirements:
A. To pay to the city recorder a license fee in the amount of $25.00 per day, or fraction thereof, for which any auction shall be held; further providing, that for any auction held after the hour of 5:00 p.m. Pacific Standard Time and ending prior to 12:00 midnight of the same day, there shall be an additional licensing fee of $10.00.
B. To post a $100.00 surety or cash bond with the city recorder to be held by the city recorder for the period that the applicant does business in the city of Rainier, plus 10 days thereafter, the conditions of such bond being to insure compliance with local ordinances and regulations and with the laws of the state of Oregon, and as security for any fines or costs that may be imposed upon the licensee and which deposit shall also be available on behalf of licensee’s creditors for claims arising in connection with licensee’s business. 5.20.030 License made available for inspection.
Any auctioneer doing business as such shall be presumed to be the agent of the person, firm, or corporation licensed to operate an auction within the city and such license shall be kept in the possession of such auctioneer and such license shall be available for the inspection of any peace officer, or any citizen, upon demand at all reasonable times during the period at which an auction business is being conducted. 5.20.040 Abatement of nuisance.
The marshal and all city peace officers of the city of Rainier are hereby required and directed to abate any such nuisance as described in RMC 5.20.010. (Ord. 627 § 4, 1952)
5.20.050 Exclusions.
All charitable, fraternal, religious, and other nonprofit organizations or corporations are hereby excluded from the provisions of this chapter. (Ord. 627 § 5, 1952)
5.20.060 Violation – Penalty.
Any person convicted of perpetrating a nuisance as described in RMC 5.20.010, or of violating any of the terms or conditions of this chapter, upon conviction thereof, shall be fined in a sum of not less than $25.00 nor more than $250.00, together with the costs of the proceeding, which said fine may be satisfied, if not paid in cash, by execution against the person of anyone convicted of committing the misdemeanor herein prohibited.
