2.15.010 Chief executive officer.

The mayor shall be the chief executive of the city and the administrative powers, authority, and duties of the city are vested in the mayor (Section 10-3-808, Utah Code Annotated 1953) [Code 1988 § 2-3-1].

2.15.020 Presiding officer of city council – Mayor pro tempore.

The mayor shall be the chairman and preside at the meetings of the city council. In the absence of the mayor or because of his inability or refusal to act, the city council may elect a member of the city council to preside over the meeting as mayor pro tempore, who shall have all of the powers and duties of the mayor during his absence or disability. To facilitate continuity in the appointment process the council may, at the first council meeting of each year or as soon thereafter as practical, elect a member of the council as the “standing mayor pro tempore” to serve in that capacity for such period of time as may be specified in the motion or the duration of the calendar year, whichever is shorter. The election of a mayor pro tempore and the length of the term of appointment shall be entered in the minutes of the meeting of the city council. 2.15.030 Duties of mayor.

The mayor shall have the following powers and duties:

A. Shall be the chief executive officer to whom all employees of the city shall report;

B. Shall keep the peace and enforce the laws of the city;

C. Shall remit fines and forfeitures and may release any person imprisoned for violation of any city ordinance;

D. Shall report such remittance or release to the city council at its next regular session;

E. Shall perform all duties prescribed by law, resolution, or ordinance;

F. Shall ensure that all laws and ordinances and resolutions are faithfully executed and observed;

G. May at any reasonable time inspect and examine the books, papers, records, or documents of the city or of any officer, employee or agent of the city;

H. Shall report to the city council the condition of the city and recommend for council consideration any measures as deemed to be in the best interests of the city;

I. Shall, when necessary, call on the residents of the city over the age of 21 years to assist in enforcing the laws of the state and the ordinances of the city;

J. Shall sign all city ordinances, resolutions and licenses and is authorized to sign his name officially for and in behalf of the city to all deeds, bonds, contracts, leases and other writings to which the city is party, when so directed by the council. 2.15.040 Appointments.

Except as may be otherwise specifically provided by law or ordinance, the mayor, by and with the advice and consent of the city council:

A. Shall, on or before the first Monday in February following a municipal election, appoint a qualified person to each of the offices of city recorder, treasurer and chief of police.

B. May also appoint and fill vacancies in all such offices and agents as may be provided for by law or ordinance.

C. Shall appoint persons to fill city offices or vacancies on commissions or committees.

D. May assign or appoint any member or members of the council to administer one or more department of the city, and/or change the assignment of any member serving in any administrative position. (Sections 10-3-809, 10-3-811, 10-3-812 and 10-3-916, Utah Code Annotated 1953) [Code 1988 § 2-3-4].

2.15.050 Budget officer.

The mayor shall be the budget officer of the city or he may appoint, with the approval of the city council, some other person to exercise the function of the budget officer. The budget officer shall perform all duties which are prescribed by this code and by the Utah Uniform Procedures Act for Utah Cities.
