10.10.010 Definitions.
For purposes of this chapter the definitions of street-legal off-highway all-terrain vehicle and nonstreet-legal off-highway all-terrain vehicle shall be defined in Sections 41-6a-102(61) and 41-6a-1509, Utah Code Annotated 1953. [Ord. 9-18-08 § 1.]
10.10.020 Operation of off-highway vehicles on Manila Town roadways and highways.
A person may not operate an off-highway vehicle upon any Manila Town street or highway vehicle except:
A. When crossing a street or highway and the operator comes to a complete stop before crossing, proceeds only after yielding the right-of-way to oncoming traffic, and crosses at a right angle;
B. When loading or unloading an off-highway vehicle from a vehicle or trailer, which shall be done with due regard for safety, and at the nearest practical point of operation;
C. When an emergency exists, during any period of time and at those locations when the operation of conventional motor vehicles is impractical or when the operation is directed by a peace officer or other public authority; or
D. When operating a street-legal all-terrain vehicle in accordance with Section 41-6a-1509, Utah Code Annotated 1953, and MMC 10.10.030. [Ord. 9-18-08 § 2.]
10.10.030 Street-legal all-terrain vehicle operation on Manila Town streets or highways.
An off-highway all-terrain Type 1 or Type 2 vehicle that meets all the requirements of Section 41-6a-1509, Utah Code Annotated 1953, may be operated as a street-legal ATV on any Manila Town street or highway that is a highway with no more than one lane in each direction. [Ord. 9-18-08 § 3.]
10.10.040 Nonstreet-legal all-terrain vehicle use on the streets or highways of the town of Manila.
A. Pursuant to Section 41-22-10.5, Utah Code Annotated 1953, the town of Manila may choose to designate or not to designate, as it wishes, certain streets or highways within its jurisdiction as open for nonstreet-legal, general off-highway vehicle use.
B. The governing body for the town of Manila desires to promote and protect the health, safety, and general welfare of all the citizens who live within or visit the jurisdictional boundaries of the community. Therefore, the town of Manila chooses not to designate any of the streets or highways within its jurisdictional boundaries as open for use by general, nonstreet-legal off-highway vehicle use.
C. Except as provided under Section 41-22-10.3, Utah Code Annotated 1953, a person may not operate a nonstreet-legal off-highway vehicle on any town of Manila street or highway in accordance with this chapter and Section 41-22-5.5, Utah Code Annotated 1953, and it shall be illegal to do so.
D. This chapter does not apply to off-highway implements of husbandry under Section 41-22-5.5, Utah Code Annotated 1953. [Ord. 9-18-08 § 4.]
10.10.050 Violation and penalty.
A violation of this chapter shall be a Class C misdemeanor, punishable in accordance with Utah state law. [Ord. 9-18-08 § 5.]
