TOW TRUCK ROSTER

9.10.010 TOWING ROSTER.
The Chief of Police shall establish a roster of companies qualified to provide City authorized and City requested towing services. Any towing company which meets the requirements set forth in BMC 9.10.020 shall, upon request, be placed on the roster. (Ord. 4391 §1 (in part), 1992)
9.10.020 ELIGIBILITY QUALIFICATIONS.
In order to be eligible to provide City authorized and City requested towing to the City, a towing operator shall:
(a) Own and maintain within the City at least three (3) Class A tow trucks;
(b) Own and maintain within the City at least one (1) Class C tow truck;
(c) Maintain an impound lot located within one (1) mile of the City of Bremerton;
(d) Whenever an operator is not open for business and does not have personnel present at the impound lot, the operator must post a phone number at that location for purposes of public contact for release of vehicles and/or personal property. An operator must maintain personnel who can be contacted twenty-four (24) hours a day to release impounded vehicles within a sixty (60) minute period of time; and
(e) Possess a valid City of Bremerton business license. (Ord. 5437 §1, 2021; Ord. 4391 (in part), 1992)
9.10.030 ROTATING ROSTER.
Towing operators placed by the Chief of Police on the roster maintained in accordance with BMC 9.10.010 shall have the exclusive right to provide City authorized and City requested tows; provided, however, that the various individual towing operators shall be granted such right on a rotating basis, for periods of thirty (30) days; and provided further, that if during the towing operator’s period of rotation the City has need for towing services which the towing operator does not possess the equipment to meet, the City may, at its option, request towing services from any towing operator capable of meeting those needs. Any corporate entity owning or controlling one (1) or more tow companies shall be considered a single company for the purposes of the rotating roster. (Ord. 5481 §1, 2023; Ord. 4391 (in part), 1992)
9.10.040 ADDITIONS TO ROSTER.
Towing operators which qualify for placement upon the roster after the initial roster is established shall enter the rotation provided for in BMC 9.10.030 only after each operator on the roster has completed one additional month in the rotation. (Ord. 4391 (in part), 1992)
9.10.050 COMPLIANCE WITH STATE LAW.
All tow operators maintained on the roster operated or created herein shall comply with requirements set forth in RCW 46.55. The failure of a contractor to comply with the requirements set forth therein shall result in its name being stricken from the roster. (Ord. 4391 (in part), 1992)
9.10.060 FEES.
Fees charged by the towing operators to the City for City authorized and City requested tows shall be those then in effect under the Washington State Patrol towing contract with the exception that no additional fees will be charged for release of property after regular business hours.
