2.44.010 Established.
There is established a library of the city to be known as the Brewster Public Library. (Ord. 570 § 1 (part), 1993)
2.44.020 Fund established—Purpose.
There is established a fund for the support and maintenance of such library to be known as the public library fund, to be kept by the city treasurer, who shall record all funds made available for such public library, whether by appropriation of the city council, or by gift or otherwise, and which fund shall be used for library purposes only. 2.44.030 Library board created—Membership—Terms—Appointment.
There is established a library board, consisting of five trustees (members) who shall be selected as follows:
A. All members shall be appointed by the mayor and confirmed by the city council. All appointments and reappointments to a position shall be made in writing by the mayor.
B. At the time of appointment and throughout his/her term of office, each member of the library board shall reside within the city or in Okanogan County within four miles of the city limits of the city. Any members who ceases to qualify as a member of the library board under this subsection during his/her term of office shall forfeit the office.
C. The initial terms shall be staggered. Position 1 shall be appointed for a term expiring December 31, 1994; Position 2 shall be appointed for a term expiring December 31, 1995; Position 3 shall be appointed for a term expiring December 31, 1996; Position 4 shall be appointed for a term expiring December 31, 1997; and Position 5 shall be appointed for a term expiring December 31, 1998. Following the initial term, each member of the library board shall serve for five years, except as otherwise provided in this chapter. No person shall be appointed to the library board for more than two consecutive terms.
D. Vacancies occurring other than through the expiration of terms shall be filled for the unexpired terms of the position number vacated.
E. Library board members may be removed only by a majority vote of all of the members of the city council. (Ord. 570 § 1 (part), 1993)
2.44.040 Organization—General powers and duties.
The library board shall annually at the first meeting of the board in January elect such officers as it deems necessary and shall have the following powers and shall perform the following duties:
A. Adopt such bylaws, rules and regulations for its own guidance and for the government of the library as it deems expedient;
B. Have the supervision, care and custody of an property of the library, including the rooms or buildings constructed, leased or set apart therefor;
C. Employ a librarian, and upon his/her recommendation employ such other assistants as may be necessary, prescribe their duties, fix their compensation, and remove them for cause;
D. Submit annually to the legislative body a budget containing estimates in detail of the amount of money necessary for the library for the ensuing year;
E. Have exclusive control of the finances of the library;
F. Accept such gifts of money or property for library purposes as it deems expedient;
G. Lease or purchase land for library buildings;
H. Lease, purchase or erect an appropriate building or buildings for library purposes, and acquire such other property as may be need therefor;
I. Purchase books, periodical maps and supplies for the library; and
J. Do all other acts necessary for the orderly and efficient management and control of the library. (Ord. 570 § 1 (part), 1993)
2.44.050 Rules of procedure.
The library board may adopt rules of procedure for the conduct of meetings and other functions delegated to the library board by the city council; provided that the rules of procedure adopted are in accordance with state law and city ordinances. The rules of procedure need not be approved by the city council. (Ord. 570 § 1 (part), 1993)
2.44.060 Report to council—Transactions.
The library board, on or before its first regular meeting in February of each year, shall make a full report in writing to the city council of its transactions and expenditures, if any, for the preceding year, with such general recommendations as to matters covered by its prescribed duties and authority as may to it seem proper. 2.44.070 Meetings.
The library board shall meet on the first Thursday of each month at seven p.m. in the city hall. In the event that any regular meeting date falls on a city holiday, the meeting shall be conducted on the next regular business day unless a special meeting date is set in advance. All meetings, both regular and special, shall be open to the public and shall be conducted in accordance with RCW Chapter 42.30, State Open Public Meetings Act, as the same now exists or may be hereafter amended. 2.44.080 Quorum.
A majority of the membership of the library board shall constitute a quorum for the transaction of business. Unless otherwise specified by state law, or city ordinance, (A) a quorum shall be required for the transaction of any business of the library board, and (B) in actions requiring a vote of the library board a favorable vote of the majority of those library board members present and constituting a quorum shall be required for approval of all motions. Any action taken at a regular or special meeting of the library board shall be deemed and taken as an action of the library board. (Ord. 570 § 1 (part), 1993)
2.44.090 Designation of secretary.
The city librarian appointed pursuant to Section 2.44.040 shall act as the library board’s secretary. The library board secretary shall prepare written minutes of the library board meetings and present the same for approval of the library board at the next regular meeting of the library board. The library board secretary shall provide a copy of the minutes of the library board meetings to the city council after they have been adopted by the library board. (Ord. 570 § 1 (part), 1993)
2.44.100 Compensation—Expenses.
Library board members shall not receive a salary or other compensation for service as board members, but necessary expenses actually incurred shall be paid from the library funds. (Ord. 570 § 1 (part), 1993),
