5.24.010 License—Required.
It is unlawful for any person, firm or corporation to maintain, keep or operate within the town, any game of skill without first obtaining a license therefor in accordance with the provisions of this chapter. (Ord. 110 § 1, 1939)
5.24.020 Game of skill defined.
“Game of skill” as used in this chapter means and includes all games involving an element of skill capable of being played or operated with or upon any mechanical device or machine of any kind, nature or description in the playing or operation of which a player may be entitled to receive, whether automatically or otherwise, any awards, or any right to further operate such machine or device. 5.24.030 License—Application—Required information—Issuance.
Any person, firm or corporation desiring to maintain, keep or operate any such game of skill, as defined in Section 5.24.020, shall apply for license to do so in writing to the town clerk. Such application shall state the name of the applicant, who must be a resident of the town, or the owner of the business where it is proposed to operate the same, the kind of machine, number thereof and the place where the same shall be maintained and operated, the serial number of such machine or device and the total number of such games desired to be licensed. Upon approval of the application by the town council, and the payment of the fees therefor, the town clerk, shall issue a license to the applicant to operate such machine or device for which the license has been applied and paid for. 5.24.040 License—Fees—Duration—Renewal.
A. The license shall be issued only for a period of one month, upon the payment of such license fee for each skill game, not less than five dollars nor more than fifty dollars per month as the town council shall by resolution from time to time establish.
B. All license fees shall be due and payable in advance, and shall be issued for each particular machine or device licensed and no license shall be transferred from one location to another. After being once licensed, the same may be renewed from month to month by payment of the monthly fee for the same machine without further approval by the town council. In absence of any resolution by the town council, the minimum rates established in this chapter shall prevail, but upon the establishment of a different rate within the limits hereinabove established by resolution of the town council, such different rate shall be in effect beginning with the first day of the next succeeding calendar month, and shall continue until further change by resolution of the town council. 5.24.050 Operation by minors prohibited.
It is unlawful for any person, firm or corporation to permit or allow any such game or device as defined in Section 5.24.020, then its possession or under, his, their or its control to be played or operated by any minor. (Ord. 110 § 5, 1939)
5.24.060 Games prohibited in proximity to school grounds.
No license shall be issued for the operation or maintenance of any such machines or devices in any place located within five hundred feet of the public school grounds. (Ord. 110 § 6, 1939)
5.24.070 Tag issuance—Display required.
The town clerk shall deliver to each applicant at the time the license is issued a tag or certificate for each machine or device licensed, and the tag or certificate shall at all times be displayed upon the licensed machine or device and the absence of such tag or certificate shall be deemed a violation of the provisions of this chapter. 5.24.080 License—Revocation.
The town council reserve’s the right to revoke any and all such licenses issued under this chapter, either without or with notice to the holder thereof, and in the event of such revocation no part of the unearned portion of such license fee shall be refunded. (Ord. 110 § 8, 1939)
5.24.090 License—Expiration.
All licenses issued under this chapter shall expire on the last day of each month; provided, that the first licenses issued on any such skill game after the first of the month shall be issued for the proportionate part of the balance of that month for each and every machine or device covered by the license. 5.24.100 Violation—Penalty.
Any person, firm or corporation found guilty of the violation of any of the provisions of this chapter shall be fined in the sum of not exceeding one hundred dollars or by imprisonment in the jail for not exceeding thirty days, or by both such fine and imprisonment, as the police justice may determine.
