9.28.010 Growth, manufacture, possession or use of marihuana prohibited—Exceptions—Penalty.

A. It is unlawful for any person within the town limits to grow, manufacture, possess or use marihuana; provided, however, this shall not apply to possession or use by registered pharmacists, physicians, dentists, veterinary surgeons, drug jobbers, drug wholesalers or drug manufacturers in the lawful pursuit of their business or occupation. The definitions contained in the Controlled Substances Act of the state of Washington shall be controlling as to definitions; under this section.

B. The penalty upon conviction of this offense shall be a fine not to exceed two hundred fifty dollars. (Ord. 383 (part), 1979)
