INTERSECTION AVOIDANCE

10.32.030 Avoidance of an intersection.
10.32.010 Definitions.
The following terms shall have the following definitions for purposes of this chapter:
A. “City street” shall have the meaning set forth in RCW 46.04.120, and means every public highway, street, or right-of-way, or part thereof, located within the city limits of the city, except alleys.
B. “Public or private road, driveway, or parking area” includes every way or place in public or private ownership that is not a city street and is used for travel and/or parking of vehicles by the owner or those having express or implied permission from the owner, but not by other persons.
C. “Public or private official” means the mayor or his or her designee, police officers, firefighters, and any person who shall drive an emergency vehicle as authorized by RCW 46.61.035 in the execution and dispatch of their official duties. (Ord. 816 § 1 (part), 2009)
10.32.020 Applicability.
A. This chapter shall apply to the operation of all motor vehicles within the city limits which enter or exit from a city street onto a public or private road, driveway, or parking area for purposes of avoiding an intersection with traffic control devices.
B. Nothing in this chapter shall be construed to prohibit avoiding an intersection at the direction of a public or private official. (Ord. 816 § 1 (part), 2009)
10.32.030 Avoidance of an intersection.
It shall be unlawful for any person operating a motor vehicle upon any city street in the city to turn such vehicle either to the right or to the left upon approaching or leaving an intersection and to proceed across any public or private road, driveway, or parking lot for the purpose of avoiding the intersection or any traffic control device controlling the intersection, unless so directed by a public or private official. 10.32.040 Exemptions.
It is not a violation of this chapter if:
A. A vehicle comes to a complete stop while on the public or private road, driveway, or parking area for a period of time of not less than sixty seconds.
B. An occupant of the vehicle exits the vehicle to participate in personal business or activities on or within the public or private road, driveway, or parking area. (Ord. 816 § 1 (part), 2009)
10.32.050 Penalty.
Any violation of this chapter shall be considered a traffic infraction. Any person found to have committed the infraction of avoiding an intersection shall be subject to a monetary penalty in accordance with the most recent bail schedule which has been adopted by the Brewster municipal court.
