5.30.010 License required.
No person, firm, corporation, transient, merchant, church, club, charitable organization or peddler shall vend, sell, dispose, display, advertise or offer to vend, sell, dispose, display or advertise any real or personal property, goods, wares, merchandise, produce, product or service upon the sidewalks of the city of Centralia without having first obtained a license from the city clerk-treasurer for that purpose upon that portion of the sidewalk immediately adjacent to applicant’s place of business or residence as limited in this chapter. (Ord. 1471 § 1, 1980).
5.30.020 Application for license.
Application for license to vend, sell, dispose, display, advertise or offer to vend, sell, dispose, display or advertise any real or personal property, goods, wares, merchandise, produce, product or service upon such adjacent sidewalk of the city of Centralia shall be made in writing to the city clerk-treasurer on forms provided for such purpose. The application shall contain the name of the applicant if an individual, the names of partners if a partnership, or the names of the principal officers if a corporation, church, club or charitable organization, and shall include the location of the place or places where such activity is to take place, the time period thereof, and the date of the application. 5.30.030 License fee.
A license fee shall be charged at the rate of ten dollars per year. The license issued shall be valid for the calendar year in which it is issued only. (Ord. 1471 § 4, 1980).
5.30.040 Insurance required.
The applicant for such license shall furnish proof of insurance to the city clerk-treasurer that the applicant is insured for injury or death of any person in the minimum sum of three hundred thousand dollars and for damage to property in the minimum sum of one hundred thousand dollars. The applicant shall hold the city of Centralia harmless from any liability for personal injury or death of any person or property damage occasioned by any reason by the applicant’s use of any sidewalk for the purpose stated in the application, and the license of the city shall be so conditioned along with the requirement that the required insurance remain in force during the license period. Acceptance of the license by the applicant shall be deemed acceptance of such conditions and requirements. (Ord. 1471 § 3, 1980).
5.30.050 Sidewalk blockage prohibited.
No sidewalk shall be blocked by any merchandise offered for sale hereunder or by any table, counter, display case or other device used for such purpose. A four-foot passageway or two-thirds of such sidewalk, whichever is greater, shall be left open for pedestrians and such area may not be licensed hereunder; provided, however, in the event a light standard or other permanent obstruction is located on the sidewalk area, the required passageway shall be computed from the building side of such obstacle. Items sold shall be securely and adequately placed so as not to endanger passersby or fall or extrude into any passageway, street or alley. Such sales shall not be operated in any manner which would cause a nuisance or create a fire hazard. (Ord. 1471 § 5, 1980).
5.30.060 Inspections.
The chief of police, fire chief and the building inspector of the city of Centralia, shall make or cause to be made sufficient inspections to ensure the compliance with the provisions of this chapter and other applicable provisions of city ordinances by the personnel conducting activities for which a license is issued hereunder. 5.30.070 Revocation of license.
The city shall have the right to revoke said license by written notice within thirty days. (Ord. 1471 § 8, 1980).
5.30.080 Temporary license granted to one general applicant.
Notwithstanding any provision of this chapter to the contrary and in recognition of certain occasions whereby the general business district or other general area, such as the “fiesta days” business sales, schedule a promotion, a temporary license may be granted to one general applicant such as the chamber of commerce on behalf of the individual persons or businesses so participating providing that such applicant shall meet the insurance requirements of CMC 5.30.040, pay a license fee of twenty dollars and such license period will not exceed five days. For purposes of this section, at least twenty separate persons or businesses must be engaged in such a general promotion. (Ord. 1471 § 9, 1980).
5.30.090 Violation—Penalty.
Any person, firm or corporation violating any provision of this chapter shall be fined not less than five hundred dollars for each offense, and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. (Ord. 1471 § 7, 1980).
