18.48.010 Required—In certain occupancies.

Smoke detectors shall be installed and maintained in accordance with the provisions of this chapter in the following occupancies that are rented, leased, or let to a person or persons:

A.    Group R, Division 1 of the Uniform Building Code, 1994 Edition, Guest Rooms and Dwelling Units, i.e., hotels, motels, apartments and condominiums;

B.    Group R, Division 3 of the Uniform Building Code, 1994 Edition, Dwelling Units, i.e., duplexes, single-family dwellings and lodginghouses;

C.    Mobile home dwelling units. (Ord. 1848 § 108, 1995: Ord. 1424 § 1, 1979).

18.48.020 Required—Dwelling unit.

On and after January 1, 1980, no owner nor the agent of any owner shall sell or offer for sale, transfer or offer to transfer, the ownership of any dwelling unit or building containing one or more dwelling units unless an approved smoke detector system shall be first installed in accordance with the permit and other requirements of this chapter. For purposes of this section, “dwelling unit” means a single unit providing permanent living facilities for one or more persons, including provisions for sleeping, eating, cooking and sanitation, but does not include campers or travel trailers or similar vehicles intended only as temporary living quarters. 18.48.030 Type.

Smoke detectors installed in accordance with the provisions of this chapter shall be of an approved type conforming to Uniform Building Code Standard 43-6 or of a type listed by a nationally recognized testing laboratory. (Ord. 1424 § 3, 1979).

18.48.040 Method of installation.

The method of installation of smoke detectors shall be in accordance with the provisions of the 1994 edition of the Uniform Building Code, Section 1310 for hotels, motels, apartments and condominiums and Section 1413 for duplexes, single-family dwellings, lodginghouses and mobile homes.

A.    The building owner or agent shall be responsible for the installation.

B.    A no-fee permit shall be required for the installation of smoke detectors. Said permit may be obtained at the building inspector’s office, City Hall.

C.    The building owner or agent shall provide or post within each guest room or dwelling unit, written operating instructions for the smoke detector installed therein. (Ord. 1848 § 109, 1995: Ord. 1424 § 4, 1979).

18.48.050 Maintenance responsibility.

Maintenance of smoke detectors shall be the responsibility of the tenant who shall maintain the device in accordance with the instructions of the manufacturer. When an occupancy is vacated, the building owner or agent shall insure that smoke detectors are operational prior to reoccupancy. (Ord. 1424 § 5, 1979).

18.48.060 Installation date.

Smoke detectors required by this chapter shall be installed in all occupancies listed in CMC 18.48.010 by November 1, 1979. (Ord. 1430 § 1, 1979: Ord. 1424 § 6, 1979).

18.48.070 Violation—Penalty.

Any person violating any provision of this chapter shall, upon conviction thereof, be punished by a fine of not more than five hundred dollars. (Ord. 1424 § 7, 1979).
