7.04.010 Hours—Responsibility of parents and guardians—Duty of sheriffs.

(a)  Every person who—being under the age of eighteen years, and not being accompanied by a parent, guardian, or a person over the age of eighteen years, and having a legal charge of such person, who shall remain on the streets, alleys, or in any public place or building of amusement or entertainment or upon any public highways, unoccupied premises or grounds in the county of Chelan after the hours of ten p.m.; or being the parent, guardian, or other person having legal charge of any person under the age of eighteen years, shall knowingly permit such person to be upon the streets, alleys, or in any public building or place of amusement or entertainment or upon any public highways, unoccupied premises or grounds in the county of Chelan, after the hour of ten-thirty p.m. unless said minor person has been sent upon some proper or necessary errand by said parent, guardian, or other person having legal charge of such minor, shall be deemed guilty of a violation of this section;

(b)  It shall be the duty of the sheriff or any deputy sheriff of said county who shall find any minor person under the age of eighteen years upon the streets, alleys, or in any public building or place of amusement or entertainment or upon any public highways, unoccupied premises or grounds in the county of Chelan, in violation of this section, to order such persons to immediately return to their homes, and upon failure to comply with the order, such person shall be arrested and detained by the officer. 7.04.020 Penalty for violations.

Any person violating paragraph (2) of Section 7.04.010 of this chapter shall be subject to arrest and upon conviction thereof shall be subject to a fine of not less than one dollar nor more than twenty-five dollars or by imprisonment in the county jail for not more than thirty days, or by both such fine and imprisonment; provided, further, that the arresting officer shall have the right to take under arrest and deliver any minor or minors found violating the provisions of Section 7.04.010, to the parent, guardian or other legal custodian of such minor or minors, provided that such parent, guardian or other legal custodian will make sure to such officers that at such time as required, they will have the minor or minors forthcoming to answer the charge conferred against the minor or minors under this chapter. 7.04.030 Severability.

If any of the provisions of this chapter are held invalid or unconstitutional, the remainder of the chapter shall not be affected thereby. (§ 3 of Res. 143-A, June 21, 1943 at Vol. 272 page 282).
