2.79.020 Fees.

(1)    Basic Process Service of Summons and Complaint, Notice and Complaint, Summons and Petition, Notice and Small Claim or Other Routine Civil Process.

(a)    Service on one (1) person at any location—thirty dollars ($30.00). Service on two (2) or more persons at the same location, at the same time, and on the same case—forty dollars ($40.00). Service fee includes failed service after due diligence.

(b)    Each return of service or return of not found—fifteen dollars ($15.00).

(c)    Notary service—ten dollars ($10.00) for each return.

(d)    Mileage required for service will be charged at the rate of fifty-five cents ($0.55) per mile, measured in five (5) mile increments for distances over twenty (20) miles round trip, with a minimum ten dollar ($10.00) charge.

(e)    Cancellation fee for subsections (1)(a) through (d) of this section—twenty dollars ($20.00).

(2)    Writs of Restitution or Assistance, Relating to Eviction Orders.

(a)    Execution without physical standby of sheriff—fifty-five dollars ($55.00).

(b)    Execution with physical standby of sheriff—ninety-five dollars ($95.00) for first hour and fifty dollars ($50.00) for each additional hour.

(c)    Each return of service or return to court—fifteen dollars ($15.00).

(d)    Mileage required for service/execution will be charged at the rate of fifty-five cents ($0.55) per mile, measured in five (5) mile increments for distances over twenty (20) miles round trip, with a minimum ten dollar ($10.00) charge.

(e)    Cancellation fee for subsections (2)(a) through (d) of this section—twenty dollars ($20.00).

(3)    Writs of Execution or Replevin or Attachment, Orders of Sale and Other Special Court Actions.

(a)    Record/levy a writ of attachment or execution or order of sale with the auditor—twenty-five dollars ($25.00), in addition to the auditor’s recording fee.

(b)    Levy and execution of writ or order—sixty dollars ($60.00) per hour—includes review, document preparation prior to levy, execution or recording and sale preparation.

(c)    Service of documents upon a defendant or debtor—thirty dollars ($30.00). Service of documents on two (2) or more defendants or debtors, at the same location, at the same time, and on the same case—forty dollars ($40.00). Service fee includes failed service after due diligence.

(d)    Service by publication preparation and proofing—thirty dollars ($30.00), in addition to the costs of publication.

(e)    Public notice preparation and proofing—ten dollars ($10.00), in addition to the costs of publication.

(f)    Each return of service or return to court or return of not found—fifteen dollars ($15.00).

(g)    Each affidavit of mailing—twenty-five dollars ($25.00).

(h)    Posting of each notice of sale or notice of postponement—twenty-five dollars ($25.00).

(i)    Mileage required for service/execution will be charged at the rate of fifty-five cents ($0.55) per mile, measured in five (5) mile increments for distances over twenty (20) miles round trip, with a minimum ten dollar ($10.00) charge.

(j)    Conducting sale of property—fifty dollars ($50.00) per hour.

(k)    Each bill of sale or certificate of sale—sixty dollars ($60.00).

(l)    Each certificate of redemption or sheriff’s deed—seventy-five dollars ($75.00).

(m)    Mailings—actual costs.

(n)    Making necessary copies when sufficient copies are not provided—three dollars ($3.00) for first page and one dollar ($1.00) for each page thereafter.

(4)    Writs of Habeas Corpus.

(a)    Service of writ—thirty dollars ($30.00)—each person.

(b)    Execution of writ—sixty dollars ($60.00) per hour.

(c)    Each return of service or return to court—fifteen dollars ($15.00).

(d)    Mileage required for service/execution will be charged at the rate of fifty-five cents ($0.55) per mile, measured in five (5) mile increments for distances over twenty (20) miles round trip, with a minimum ten dollar ($10.00) charge.

(5)    Miscellaneous.

(a)    Noncriminal fingerprinting—fifteen dollars ($15.00) for one (1) card and five dollars ($5.00) for each additional card, per person.

(b)    Reproduction of audio, visual or photographic material—actual cost plus staff time.

(c)    Serving an arrest warrant—fifty dollars ($50.00).

(d)    Service of any type document and supporting paperwork, including those documents related to a dissolution of marriage proceeding except as provided in subsection (5)(e) of this section, on one (1) person not identified herein—thirty dollars ($30.00). Service of any type document and supporting paperwork on two (2) or more persons at the same location, at the same time, on the same case, not otherwise identified herein—forty dollars ($40.00).

(e)    Service of protective orders and anti-harassment orders will not be assessed a fee.

(6)    Fee deposits may be required for acceptance of the case. Deposit balances of ten dollars ($10.00) or less at the closing of the case will not be refunded. (Sec. 1 of Ord. 2017-09-04)
