The surcharge shall be assessed as follows:
A. For a load delivered by a vehicle greater than or equal to one ton capacity, the surcharge shall be twenty-five dollars ($25) for the first violation and one hundred dollars ($100) for the second and any successive violation for said vehicle within any twelve (12) month period. The county director of public services or his/her designated representative may take other measures or remedies against any person who violates this section more than two (2) times in any twelve (12) month period.

For a load delivered by a vehicle less than one (1) ton capacity (“small public loads”), the surcharge shall be seven dollars and fifty cents ($7.50) for the first violation and twenty dollars ($20) for the second and any successive violation for said vehicle within any twelve (12) month period. As an alternative to payment of the surcharge established for a first time violation, the violator may purchase a tarp available at the facility in lieu of payment of the surcharge.
