10.08A.120 Penalty.

Notwithstanding any penalties provided for in RCW 46.44.045, and in addition to any other penalties provided for in this code, the following penalties will apply:

(1)    For violations of Section 10.08A.040(1) or (3), the penalty shall be one hundred dollars ($100) plus three cents ($0.03) per pound over the legal limit for the first five thousand (5,000) pounds and five cents ($0.05) per pound for each pound thereafter;

(2)    For violations of Section 10.08A.070, the penalty shall be five hundred dollars ($500) minimum, plus three cents ($0.03) per pound overweight for the first five thousand (5,000) pounds and five cents ($0.05) per pound for each pound thereafter;

(3)    The penalties provided for in subsections (1) and (2) above will be increased by a factor of two (2) for a person’s or company’s second violation of this code provision within a one (1) year time period. For the third and subsequent violations of this code provision within a one (1) year time period, the penalties provided for in subsections (1) and (2) shall be increased by a factor of three (3).
