The following governmental codes establish the county’s right to grant franchises and permits and to regulate the use of county road rights-of-way:
A. Chapter 19.122 RCW—Underground Utilities. Assigns responsibilities for protecting and repairing damage to existing underground facilities and protecting the public health and safety.
B. Chapter 36.55 RCW—Franchises on Roads and Bridges. Establishes legal basis for counties to grant non-exclusive franchises to use county right-of-way for the construction and maintenance of utilities.
C. Chapter 36.87.140 RCW—Retention of Easement for Public Utilities. Establishes the basis for counties to retain an easement for public utilities when authorizing vacation of a county road.
D. Chapter 80.32.010 RCW—Electric Transmission Line Franchises. Establishes the legal basis for franchise of electric transmission lines.
E. Chapter 80.36.040 RCW—Telecommunication Lines. Establishes the right to construct telecommunication lines along public rights-of-way.
F. Chapter 136-40 WAC—Accommodation of Utilities. Outlines standard of good practice for county road departments with regard to the accommodation of utilities on county right-of-way.
G. Clark County Code 13.12A—Underground Utility Permit. Sets forth the requirements for permits and fees. (Note: this section will be amended)
