24.12.060 Scope and applicability.
(1) The provisions of this chapter shall apply to all persons, acting either as principles or agents, or acting either as masters or servants, who engage in the collection, storage, handling, utilization or disposal of solid waste within the unincorporated areas of Clark County.
(2) The provisions of this chapter shall cover existing operations and activities and no person shall continue the operation of a solid waste disposal site or solid waste handling facility thirty (30) days after the effective date of the ordinance codified in this chapter until said person applies for the necessary or requisite permits therefor from Clark County public health. If said permit is denied, the applicant shall final cover immediately, complete the site as per prior permits, and desist in disposal.
(3) The following solid waste activities shall be exempt from any permit requirements of this chapter:
(a) Any person may dump or deposit solid waste resulting from his own residential or agricultural activities onto or under the surface of the premises from which the waste was generated so long as a nuisance is not created thereby; and provided that the waste so disposed does not create a potential health, sanitation or vector problem.
(b) Any person may fertilize grass, flower beds, flowers, gardens, landscaping and any other vegetation of any kind, for commercial or residential purposes, if done accessory to, or in furtherance of a use permitted on the premises under zoning laws.
(c) Any composting activity accessory to another permitted use on the premises shall be a permitted use for which a permit is not required.
(d) Any person may dump or deposit non-putrescible commercial or industrial waste resulting from his own industrial or commercial activities onto or under the ground of the premises from which the waste was generated so long as a nuisance is not created thereby.
