2.48.010 Created – Members – Appointment.

There is created a city parking commission for the city which shall consist of five members, appointed by the mayor and confirmed by the city council, who shall serve without compensation but may be reimbursed for necessary expenses. One member of the parking commission shall be selected from among persons actively engaged in the private parking industry, if available. (Prior code § 1.82.010).

2.48.020 Members – Term of office and vacancy filling.

Three of the members initially appointed shall be designated to serve for one, two and three years respectively, and two shall be designated to serve for four years. The terms for all subsequently appointed members shall be four years. In the event of any vacancy, the mayor, subject to confirmation of the city council, shall make appointments to fill the unexpired portions of the term.

A. The mayor may also appoint a council representative to attend the commission meetings as a nonvoting member.

B. Any commission member may be removed during their term by the city council for sufficient cause. Sufficient cause means violation of the public trust or malfeasance. Also, removal may occur for nonparticipation in meetings.

C. The commission shall have a chairman, vice chairman, and secretary. Officers shall be elected in January of each year. The secretary shall serve as the recording secretary to the commission. It shall be the duty of the chairman to preside at all meetings of the commission and the secretary will keep official minutes of all meetings and all proceedings of the commission. Minutes will be provided to the city clerk within 10 days after a meeting.

D. A quorum of three voting members shall constitute a quorum for the transaction of business. A majority vote of those present shall be necessary to carry a proposition.

E. The commission shall fix the time and place of its meetings. The meetings of the commission shall be at least quarterly, posted on the city website, and open to the public. (Ord. 1723 NS § 1, 2024; prior code § 1.82.020).

2.48.030 Organization – Statutory authority.

Immediately following their appointment, the members of the parking commission shall meet, organize, and select a chairman, and may establish rules, regulations and procedures not inconsistent with Laws of 1969 First Extraordinary Session, Chapter 204, as the same now exists or is hereafter amended. No resolution shall be adopted by the parking commission except upon the concurrence of at least three members. (Prior code § 1.82.030).

2.48.040 Powers and duties authorized.

The parking commission is authorized and empowered in the name of the city by resolution to:

A. Own and acquire property and property rights purchased, gift, devise or lease for the construction, maintenance or operation of off-street parking facilities, and accept grants-in-aid including compliance with conditions attached thereto;

B. Construct, maintain and operate parking facilities and undertake research and prepare plans incidental thereto subject to applicable statute and ordinance provisions for municipal purchases, expenditures and improvements;

C. Establish and collect parking fees, make exemptions for handicapped persons, lease space for commercial, store, advertising or automobile accessory purposes, and regulate prices and service charges, for use of and within the aerial space over parking space under its control;

D. Subject to civil service provisions, provide for the appointment, removal and control of officers and employees and prescribe their duties and compensation and to control all equipment and property under the commission’s jurisdiction;

E. Contract with private persons and organizations for the management and/or operation of parking facilities under its control, and services related thereto, including leasing of such facilities or portions thereof;

F. Execute and accept instruments, including deeds necessary and convenient for the carrying on of its business; acquire rights to develop parking facilities over or under city property; contract to operate and manage parking facilities under the jurisdiction of other city departments and of other public bodies;

G. Determine the need for and recommend to the city council:

1. The establishment of local improvement districts to pay the cost of parking facilities or any part thereof;

2. The issuance of bonds or other financing by the city for the construction of parking facilities;

3. The acquisition of property and property rights by condemnation from the public, or in street areas;

H. Transfer its control of property to the city and liquidate its affairs, so long as such transfer does not contravene any covenant or agreement made with the holders of bonds or other creditors;

I. Require payment of any excise tax provided for by statute;

J. Exercise such other powers as are granted by statute or are germane thereto. (Prior code § 1.82.040).

2.48.050 Proposed parking development – Plans, report and specifications required.

Whenever the parking commission intends to construct new off-street parking facilities, it shall:

A. Prepare plans for the proposed development which shall be submitted for review to the city planning commission;

B. Prepare a report to the city council stating the proposed method of financing and property acquisition;

C. Specify the property rights, if any, to be secured from the public or of property devoted to public use, the uses of streets necessary therefor, or realignment or vacation of streets and alleys, the relocation of street utilities; and any street area to be occupied or closed during construction. 2.48.060 Proposed parking development – Planning commission review and public hearing requirement.

The city planning commission shall review the plans for the proposed parking development for conformance with the city comprehensive plan and shall report thereon to the city council. One or more public hearings shall be held thereon before the city council, or an assigned committee thereof, which shall report its recommendations to be approved, revised or rejected by the city council. 2.48.070 Proposed parking development – City council approval or rejection authority.

Within 60 days of the date of the hearing, the city council shall approve or reject the original or revised plan for off-street parking facilities. The city council’s approval of construction plans shall be deemed full authority to construct and complete the parking facility. (Prior code § 1.82.070).

2.48.080 Disposition of revenues.

All revenues received from or for the operation or construction of off-street parking facilities shall be paid to the city treasurer for the credit of the general fund, or such other funds as may be provided by ordinance. (Prior code § 1.82.080).

2.48.090 Expenditure regulations.

Expenditures of the parking commission shall be made in accordance with the budget adopted by the city. (Prior code § 1.82.090).

2.48.100 Parking facilities operation – Statutory authority.

The city shall not operate off-street parking facilities, except as provided for by Laws of 1969 First Extraordinary Session, Chapter 204, Section 12 of Laws of 1971 First Extraordinary Session, Chapter 45. (Prior code § 1.82.100).
