8.20.010 Public nuisance declared.
The following acts are hereby declared to be public nuisances:
(1) The kindling or maintenance of any bonfire, rubbish or trash fire or any open burning as defined in WAC 173-425-020 subpart (8) within the town of Coulee Dam during the period commencing May 1st of each year and ending on October 1st of each year.
(2) The kindling or maintenance of any open burning, bonfire, or rubbish or trash fire in the period beginning October 1st of each year and ending May 1st of each year without (a) first obtaining a permit at the town clerk’s office, which permit shall be valid for a period of 30 days from the date of issuance, and (b) full and complete compliance with Chapter 173-425 WAC entitled “Open Burning.” (Ord. 253 § 1, 1981)
8.20.020 Violation – Penalty.
Any person violating the provisions of this chapter or who shall create, keep, kindle, or maintain any outdoor fires as above defined, shall be guilty of a misdemeanor and upon conviction thereof shall be fined in an amount not exceeding $100.00 or imprisoned for a period not exceeding 30 days, or by both such fine and imprisonment. 8.20.030 Exemptions and limitations.
This chapter shall not apply to or be intended to prohibit outdoor cooking and barbecuing but shall specifically include and prohibit, although not necessarily limit, a prohibition against all trash burning in trash burners and burning barrels. (Ord. 253 § 3, 1981)
