15.20.010 Fencing and enclosure requirements.
From and after the effective date of the ordinance codified in this chapter all pools constructed hereafter which are wholly or in part outside of any residential structure shall be fenced or enclosed in such a way as to prevent unauthorized entry to the pool area, which fence or structure enclosing the proposed swimming pool shall meet the following minimum requirements:
(1) All openings or points of entry into the pool area enclosure shall be equipped with gates and doors.
(2) The top of the fence or enclosing structure, together with gates and doors, shall be a minimum of four feet and a maximum of six feet in height above the grade level and shall be constructed of a material through which humans cannot readily pass, readily climb over or readily crawl under.
(3) All gates or doors in the fence shall be equipped with self-closing and self-latching devices plated on the inside of such gate or fence and of such design to prevent opening from the outside, or kept padlocked or locked to prevent unauthorized entry.
(4) Any fence or gate constructed of wire shall be constructed with a minimum mesh and weave so that in the opinion of the building inspector such fence will prevent unauthorized entry to the pool area.
(5) The fence posts, gates or doors shall be kept in good repair sufficient to guard securely against unauthorized persons entering the pool area. (Ord. 276 § 1, 1982)
15.20.020 Inspections.
Prior to filling any swimming pool hereafter constructed after the effective date of the ordinance codified in this chapter, the owner shall have the fence inspected by the building inspector, who must be satisfied that the fence or other enclosing structure conforms to the minimum requirements of this chapter. 15.20.030 Definition.
“Swimming pool” as used in this chapter, is defined as a receptacle for water located on privately owned property, including any natural or artificial pool of water, whether located above grade or below grade, which has a depth at any point of more than 18 inches. (Ord. 276 § 3, 1982)
15.20.040 Liability provisions.
The granting of approval and the construction of any fence or other enclosing structure for a swimming pool shall not constitute a representation, guarantee or warranty of any kind or nature by the town of Coulee Dam, or any officer or employee thereof, concerning the practicality or safety thereof and shall create no liability upon or cause of action against the town of Coulee Dam, or any officer or employee thereof, for any damages or damages that may result by virtue of approval of any construction. 15.20.050 Provisions in addition to other ordinances and codes.
The requirements of this chapter shall not repeal, amend or supersede the requirements of the Uniform Building Code or any building permits required thereunder, but this chapter shall be in addition to all other ordinances and uniform codes adopted thereby. (Ord. 276 § 5, 1982)
15.20.060 Conformance requirements.
All existing swimming pools shall comply with the provisions of this chapter within six months of the effective date of the ordinance codified in this chapter. Swimming pools which do not conform with this chapter within the time specified are hereby declare to be public nuisances and public hazards, and the owner and/or occupant in possession of the premises upon which the same exist shall be subject to the penalties described herein or in the ordinance concerning public nuisances. 15.20.070 Drain line requirements.
Drain line for the pool shall not be connected to the town sewer system, and wastewater shall not be discharged to the sewer system through direct, or indirect connection to a sump or drain, so as to permit discharge of water into the town sanitary sewer system. (Ord. 276 § 7, 1982)
15.20.080 Violation – Penalty.
Any person, firm or corporation who violates any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine in any sum not to exceed $500.00 or by imprisonment for a term not to exceed 90 days, or by both such fine and imprisonment.
