9.15.010 King County sewage treatment rate.

The district shall collect the King County sewage treatment consumption charge based on water usage from customers located in the district service area of metropolitan King County per the agreement for sewage disposal. The sewer treatment rate is set by metropolitan King County Council and is passed-through to customers on the Cross Valley sewer bill. The King County sewer treatment rate is a per month per residential customer equivalent of 750 cubic feet of metered water consumption, in the amount stated in Rate Table III. The district shall notify customers of any rate changes. [Res. 2023-8-2 § 1.]

9.15.020 Cross Valley sewer collection rate.

The following classifications of sewer use and schedule of sewer service rates and charges are hereby adopted effective for district sewer service billings in the district’s King County treatment sewer service area effective January 1, 2024, January 1, 2025, and January 1, 2026:

(1) Cross Valley Sewer Collection Fixed Rate.

(a) Nonresidential Customers. Sewer service to nonresidential properties shall be charged a fixed bimonthly base rate, including up to 1,500 cubic feet of metered water usage, in the amounts established in Rate Table III.

(b) Residential Customers. In the event that residential properties connect to the Cross Valley sewer collection system, such as in the Maltby urban growth area, sewer service to residential properties shall be charged a fixed bimonthly base rate per dwelling unit, in the amounts established in Rate Table III.

(2) Cross Valley Sewer Collection Volume Rate. In addition to the fixed base rate the district will collect a volume rate on metered water usage above 1,500 cubic feet per bimonthly bill. The rate is per equivalent residential unit (ERU) of 750 cubic feet, and shall be in the amounts established in Rate Table III. [Res. 2023-8-2 § 1.]

9.15.030 Silver Lake Water and Sewer District rate.

(1) Silver Lake Sewer Charge. For the properties located in the district service area of Silver Lake Water and Sewer District, Cross Valley shall collect the pass-through rate per the interlocal agreement with Silver Lake Water and Sewer District. This rate is adjusted annually as defined by Silver Lake Water and Sewer District rate resolutions, and is currently in the amount stated in Rate Table III. The district shall notify customers of any rate changes.

(2) Silver Lake Sewer Service Surcharge. Cross Valley Water District shall collect a sewer service surcharge of up to 10 percent of the amount charged by Silver Lake for sewer service provided pursuant to interlocal agreement with Silver Lake Water and Sewer District, and is currently in the amount stated in Rate Table III. This is reviewed annually to determine the actual cost of billing and collecting the sewer service charges and forwarding payment to Silver Lake. [Res. 2023-8-2 § 1.]

9.15.040 Connection to sanitary sewer system.

(1) Required Connection. The owner of each lot or parcel of real property within the area to be served by the sewerage system of the district, and located within Snohomish County’s urban growth boundary, upon which lot or parcel of real property there shall be situated any improvements designed to be utilized for human occupancy, employment, recreation or other purposes or use abutting on any street, alley or right-of-way in which there is now located, or may in the future be located, a public sanitary sewer of the district, is hereby required at his or her expense to connect all of the sanitary plumbing facilities to the public sewer system of the district; provided, that said public sewer is within 300 feet of the property line of said parcel of real property. Any improvement hereinafter constructed or made available for human occupancy and use for any purpose shall, within 60 days after written notification of sewer availability has been issued by the district or the date of the installation of a water meter, whichever occurrence is earlier, be connected to the sewerage system of the district by the owner of the real property upon which said structure is located at his or her expense. All property shall be deemed capable of being served by the lines of the district if any plumbing of any building or structure located thereon can be served into the district’s sewer lines by gravity or by pumping provided the property served shall have direct access to the district’s sewer line.

(2) Penalty for Nonconnection. A penalty for nonconnection to the system shall be assessed in a bimonthly amount equal to the Cross Valley Sewer Collection fixed rate as set forth in CVWDC 9.15.020(1).

(3) Charge for District Expense of Making Connections to Sanitary Sewer Facilities. In the event that any owner of property shall fail or refuse to make connection as required by subsection (1) of this section, the board of commissioners of the district may cause such connection to be made and the cost certified to the Snohomish County recorder as a lien against the property served and such amount shall be collected as provided by law. 9.15.050 Side sewer permit charge.

The district shall charge a side sewer permit fee for each side sewer connection, in the amount established in Rate Table II. Side sewers shall be installed in accordance with the specifications and requirements of the district. This charge covers the application and the first inspection of the new connection to the district’s sewage disposal system. Additional inspections, if necessary, will be billed on a time and material basis in the amounts established in Rate Table II. There shall be a charge for each copy of the district’s side sewer specifications, in the amount established in Rate Table II. [Res. 2023-8-2 § 1.]
