12.26.010 Definitions.

“Camping” is overnight occupancy in self-contained camping vehicles, tents, recreational vehicles, or in any other manner.

“City park” consists of city-owned property dedicated as recreational sites within the city boundaries.

“Dusk” is the time of day between twilight and dark or the shadowy part of dark. (Ord. 975 § 1, 2018: Ord. 723 § 2, 1998)

12.26.020 Hours of operation.

City parks hours shall be from 8:00 a.m. to dusk seven days a week.

Exceptions:

A. Organized events taking place in the parks and approved in advance by the city council. (Ord. 975 § 1, 2018: Ord. 723 § 2, 1998)

12.26.100 No camping.

All camping is prohibited in the city parks. (Ord. 975 § 1, 2018: Ord. 731 § 1, 1999; Ord. 723 § 2, 1998)

12.26.110 Animals in parks – Penalties.

A. Any person owning, keeping, possessing or harboring any dog or cat in a city park shall promptly remove and dispose of all feces left by the dog or cat in a city park.

Any person violating this subsection shall be subject to a civil infraction penalty of up to $250.00 for each offense.

B. It is unlawful for any person to ride or lead or cause to be ridden or led a horse, mare, pony or related riding animal within the limits of any city park unless such activity is part of a city council approved event.

Any person whose animal is maintained or who allows an animal to be maintained in violation of this subsection shall be deemed to have committed a civil infraction and shall be subject to a civil infraction penalty in an amount not to exceed $500.00 per violation. Each day the animal is maintained in violation of this chapter after written notice from the mayor or the mayor’s designee shall constitute a separate violation. All civil infractions shall be established and all civil penalties shall be assessed, enforced, and collected through the jurisdiction of the Spokane County district court, pursuant to its procedures for notice of infractions.

C. Dogs or cats may be present in the city parks provided they are on a leash or carried by the person owning or having custody of the animal.

Any person violating any provisions of this subsection shall be subject to a civil infraction penalty of up to $250.00 for each offense. (Ord. 975 § 1, 2018: Ord. 723 § 2, 1998)

12.26.120 Violation – Penalty.

Any person violating any of the terms or provisions of this chapter with the exception of DPMC 12.26.110 shall be subject to a civil infraction penalty of up to $500.00 for each violation. (Ord. 975 § 1, 2018: Ord. 723 § 2, 1998)
