17.14.010 Application materials and format.

A.    Every final plat, final short plat and final binding site plan shall consist of one or more pages clearly and legibly drawn;

B.    A final plat, final short plat and final binding site plan shall be prepared on forms eighteen inches by twenty-four inches in size, with a two-inch border on one of the eighteen-inch sides to allow for binding, and one-half-inch borders on the other three sides. The two-inch border will typically be on the top or left side depending on the configuration of the drawing;

C.    Materials shall be those acceptable for filing as specified in WAC 332-130-050 and be formatted consistent with requirements of the county auditor;

D.    A title report or plat certificate issued within thirty days of application showing all persons having an ownership interest in the property to be divided, a legal description describing the exterior boundary of the site and listing all encumbrances affecting the site. Supplemental plat certificates must be provided to the department if the final plat, final short plat and final binding site plan is not recorded within thirty days of the original certificate or supplemental certificate date;

E.    A written copy of protective deed covenants shall accompany the final plat, final short plat or final binding site plan, if applicable;

F.    A certificate in a form prescribed by the prosecuting attorney bearing the typed or printed names of all persons having an interest in the divided land, signed by the said persons and acknowledged by them before a notary public, consenting to the division of the said land and reciting a dedication by them of all land shown on the final plat, final short plat or final binding site plan to be dedicated for public uses and a waiver by them and their successors of all claims for damages against any governmental authority arising from the construction and maintenance of public facilities and public property within the subdivision as required by RCW 58.17.165;

G.    Approval and signature blocks, as applicable, for the board, the clerk of the board, county treasurer, director, county engineer, county surveyor, county auditor, and the health district;

H.    A written statement of approval signed by the Director of the Department of Ecology as required by RCW 58.17.120 if any portion of the subdivision, short subdivision or binding site plan lies within a flood hazard zone established by DCC Chapter 15.48; and

I.    A disclosure statement shall be placed on the face of final plats, final short plats and final binding site plans that are within a flood hazard area that advises property owners and potential purchasers of the potential flood hazard on the property, and that certain activities are subject to compliance with this chapter and other applicable provisions of the Douglas County Code. 17.14.020 Contents—Map.

The following information shall be shown on a final plat, final short plat and final binding site plan:

A.    Name of subdivision, department file number, map scale and north arrow;

B.    County assessor parcel number(s) and legal description of the land being subdivided;

C.    Location by section, township and range, and by legal description;

D.    The signature and seal of the land surveyor;

E.    Boundary of land being subdivided based on relative accuracy procedures or field traverse standards, and meeting or exceeding those standards specified in Chapter 332-130 WAC;

F.    Exact location, width and name of all roads within and adjoining the plat, short plat or binding site plan;

G.    Courses and distances to the nearest established street lines or official monuments that shall accurately describe the location of the plat, short plat or binding site plan;

H.    Municipal, township, county or section lines accurately tied to the lines of the plat, short plat or binding site plan distances and courses;

I.    The location of all easements shown with dashed lines and the purpose of easements indicated;

J.    Lots designated by number on the plat, short plat or binding site plan within the area of the lot, and tracts similarly designated by letter. Each tract shall be clearly identified with the purpose and maintenance responsibility;

K.    Addresses for lots and tracts as assigned by the department;

L.    Blocks in numbered additions to plats bearing the same name may be numbered or lettered consecutively through the several additions;

M.    Accurate location of all existing and proposed permanent control monuments at each corner of the subdivision, short subdivision or binding site plan consistent with RCW 58.17.240, and at all road intersections and curve control points that fall within the pavement or as approved by the county engineer;

N.    A traverse line and any hydroelectric project-related boundary lines in accordance with DCC Section 17.38.040, when applicable;

O.    The extent of flood hazard areas and corresponding base flood elevations;

P.    Accurate boundary delineation for any areas to be dedicated or reserved for public use, along with the purposes of the use indicated thereon; and the accurate delineation of any areas to be reserved by deed covenant for common uses of all property owners;

Q.    The boundary description of the property being divided matching the description recorded in the most recent real estate transfer document encompassing the property;

R.    Restrictions, title encumbrances and notes required by the conditions of approval;

S.    Names of any adjacent subdivisions. (Ord. TLS 17-12-44C Exh. A (part))

17.14.030 Approval.

A final plat, final short plat or final binding site plan shall be approved by the director or his/her designee based on a determination that:

A.    The plat, short plat or binding site plan conforms to the plans, policies and codes in DCC Section 17.04.050 as they now exist or may hereafter be amended; and

B.    The plat, short plat or binding site plan conforms to all conditions of preliminary approval; and

C.    Appropriate provisions are made, without limitation, for:

1.    The public health, safety, and general welfare;

2.    Open spaces;

3.    Drainage ways;

4.    Streets or roads, alleys, other public ways;

5.    Transit stops;

6.    Potable water supplies;

7.    Sanitary wastes;

8.    Parks and recreation, playgrounds;

9.    Schools and schoolgrounds, and shall consider all other relevant facts, including sidewalks and other planning features that assure safe walking conditions for students who only walk to and from school; and

D.    The plat, short plat or binding site plan meets all standards established by state law and this title relating to final plat, final short plat or final binding site plan; and

E.    The plat, short plat or binding site plan bears the certificates and statements of approval required by state law and this title; and

F.    A title insurance report or plat certificate current within thirty days has been furnished by the subdivider confirming that the title of land to be divided is vested in the name of the owners whose signatures appear on the acknowledgment and dedication certificate; and

G.    Required improvements have been approved by the director, county engineer, the health district, and utility purveyors, as applicable, or financial guarantees in accordance with the provisions of DCC Chapter 14.90, Performance Assurance and Guarantee, have been posted with the county; and

H.    A warranty for maintenance in accordance with the provisions of DCC Chapter 14.90, Performance Assurance and Guarantee, has been posted with the county for all applicable improvements constructed and approved by the director, county engineer, the health district, and utility purveyors, as applicable; and

17.14.040 Recording.

The department shall file the final plat, final short plat or final binding site plan and associated documents with the county auditor for recording. (Ord. TLS 17-12-44C Exh. A (part))
