17.42.010 Corrections.
A. Any map page or document recorded with the county auditor under the provisions of this title that contains an error in fact or omission may be amended pursuant to WAC 332-130-050(3). The following types of errors may be corrected:
1. Any courses, distances or elevations omitted from the recorded document;
2. An error in any courses, distances or elevations shown on the recorded document;
3. An error in the description of the real property shown on the recorded document;
4. An error in the field location of any shown easement; or
5. Any other error or omission where the error or omission is ascertainable from the data shown on the recorded document.
B. Nothing in this section shall be construed to permit changes in courses, distances or elevations for the purpose of redesigning lot or tract configurations.
C. The corrected map page or document shall contain the seal and signature of the land surveyor making the correction.
D. The corrected map page or document shall set forth in detail the corrections made and show the names of the present fee owners of the property materially affected by the correction. The notarized signatures of the owners shall be required, if deemed necessary by the department.
E. The corrected map page or document shall be submitted to the department for review and approval and shall include approval and signature blocks for the county engineer, the director, the county surveyor, and the county auditor. An approved corrected map page or document shall be recorded with the county auditor. (Ord. TLS 17-12-44C Exh. A (part))
17.42.020 Revisions to preliminary approval.
A. A request to revise a plat, short plat or binding site plan that has received preliminary approval shall be submitted to the department.
B. Proposed revisions that would result in a substantial change, as determined by the department, shall be processed as a new application and shall be reviewed in accordance with the application classifications in DCC Chapter 14.10.
C. For the purpose of this section, a substantial change includes without limitation:
1. The creation of additional lots;
2. The reduction or elimination of open space;
3. A change in use;
4. A change in points of ingress or egress, or the addition or elimination of a road; and/or
5. A change to conditions of approval of an approved preliminary subdivision, preliminary short subdivision or binding site plan.
D. Proposed changes that do not result in a substantial change, as determined by the department, shall be processed as a minor change in accordance with DCC Section 14.10.020, Limited administrative review of applications.
E. For purposes of this section, minor changes include, but are not limited to:
1. Changes to design standards necessitated by changed circumstances, such as reconfiguration or reduction of lots;
2. Changes in lot dimensions that are consistent with the underlying zone;
3. A decrease in the number of lots to be created so long as the minimum lot size of the underlying zoning district is maintained;
4. Changes in timing of phased plans; and/or
5. Changes that reduce construction related impacts and do not eliminate off-site improvements specifically required as a condition of preliminary approval.
F. All changes are subject to the approval criteria for preliminary subdivisions, preliminary short subdivisions or binding site plans, as applicable. (Ord. TLS 17-12-44C Exh. A (part))
17.42.030 Alteration of final plat, or final short plat or final binding site plan.
Alteration of a final plat, final short plat or final binding site plan or any portion thereof shall meet all requirements of this chapter, as applicable, Chapter 58.09 RCW, RCW 58.17.035, 58.17.060, 58.17.215 through 58.17.218 and WAC 332-130-050(3), as applicable, except that alterations subject to the provisions of DCC Chapter 17.34, Boundary Line Adjustments, are exempt from the requirements of this section. 17.42.040 Vacation of final plat, final short plat or final binding site plan.
A. Vacation of a final plat or final short plat or any portion thereof shall meet the requirements of RCW 58.17.060 and 58.17.212, as applicable, and all applicable requirements of this chapter except as modified in this section.
B. Vacation of a final plat or final short plat shall be subject to the following approval criteria:
1. Adequate provision is made for roads, alleys, drainage facilities, potable water supplies, sanitary wastes, transit stops, parks and recreation, playgrounds, schools and school grounds, sidewalks and safe walking conditions for students who only walk to and from school as applicable, and other general purposes as may be required to protect the public health, safety and general welfare.
2. The public use and interest will be served.
C. Vacation of a binding site plan shall be accomplished by following the same procedure and satisfying the same laws, rules and conditions as required for a new binding site plan application, as set forth in this chapter. If a portion of a binding site plan is vacated, the property subject to the vacated portion shall constitute one lot unless the property is subsequently divided by an approved subdivision, short subdivision or another binding site plan.
