12.08.010 Definitions.
The words “lessee,” “occupant” or “owner” shall mean and include one or more persons of either sex, natural persons, corporations, partnerships, associations, joint stock companies or all other entities of any kind capable of suing or being sued. (Ord. 08-11 § 3, 2008; Ord. 278 § 4, 1979)
12.08.020 Required when.
It shall be the duty of the owner or occupant of any house or other building and the owner or proprietor, lessee or person entitled to possession of any church, public hall, public building within the city limits, abutting or bordering upon any street, avenue, highway or public place to remove or cause to be removed all snow and ice from the sidewalk in front of or adjacent to such premises to the full paved width of said sidewalk within 24 hours after such snow or ice shall have fallen or accumulated thereon. 12.08.030 Ashes, sand permitted when.
In case the snow or ice on the sidewalk is frozen so hard that it cannot be removed without injury to the pavement or concrete, the lessee, occupant, person having charge or owner of every parcel of real estate shall, within the time specified in EWMC 12.08.020, cause the sidewalk abutting or adjacent to said premises to be strewn with ashes, sand, sawdust or other material, and shall as soon thereafter as the weather shall permit, thoroughly clean such sidewalk. 12.08.035 Dumping snow in street prohibited.
It is unlawful for any owner, lessee, occupant, or their employees, agents, contractors or contractors’ employees, by any means, to scrape, plow, pile, dump, push or deposit snow on, into or upon any city street, right-of-way, or traffic sign; provided, however, this chapter neither prevents the removal of snow from public sidewalks into the streets, nor prohibits the city’s snow removal or street maintenance operation. 12.08.040 Violation – Penalty.
A violation of this chapter is a Class 3 civil infraction and will be enforced as set forth in Chapter 7.80 RCW (as enacted or as amended). Each day a violation continues is a separate offense. (Ord. 17-04 § 4, 2017; Ord. 08-11 § 3, 2008; Ord. 278 § 3, 1979)
