15.06.010 International Residential Code adopted.

The current edition of the International Residential Code, including Appendix G, as published by the International Code Council, Inc., and including all additions, deletions, and exceptions as set forth in WAC Title 51, as the same now exists or may be hereafter amended, except as amended in EWMC 15.06.020, is hereby adopted by this reference and incorporated herein as if fully set forth as the residential code for the city of East Wenatchee. 15.06.020 Amendments.

Section R105.2 of the International Residential Code is hereby amended as follows:

R105.2 Work exempt from permit. Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:

1. One-story detached accessory structures, provided the floor area does not exceed 200 square feet (18.58 m2).

2. Fences not over 6 feet (1,829 mm) high.

3. Retaining walls which are not over 4 feet (1,219 mm) in height measured from the lower grade to the top of the wall, unless supporting a surcharge or impounding Class I, II or III-A liquids.

4. Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons (18,927 L) and the ratio of height to diameter or width does not exceed 2 to 1.

5. Sidewalks, platforms, decks, and driveways not more than 30 inches (762 mm) above grade and not over any basement or story below.

6. Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.

7. Prefabricated swimming pools that are installed entirely above ground.

8. Swings and other playground equipment.

9. Window awnings supported by an exterior wall which do not project more than 54 inches (1,372 mm) from the exterior wall and do not require additional support.

10. Re-roofing in accordance with Section R907 of the International Residential Code, except where any portion of the roof sheathing is replaced.

15.06.030 Fees.

Building permit and plan review fees shall be as established from time to time by city of East Wenatchee resolution. (Ord. 04-06 § 6, 2004)

15.06.040 Enforcement.

The International Residential Code shall be enforced by the building inspector of the city. The building inspector shall be appointed as set forth by ordinances of the city and he shall be a person qualified to interpret the provisions of the International Residential Code and to enforce their requirements. 15.06.050 Conflicts.

A. In the event of a conflict between certain laws, the code adopted by reference in EWMC 15.06.010 shall not supersede or take precedence over provisions in Chapter 19.28 RCW regulating the electrical code; nor the provisions in RCW 19.27.031(4) and Chapter 15.12 EWMC regulating the plumbing code; nor the provisions in Chapter 19.27 RCW regulating the energy code.

B. In the case of a conflict between the codes adopted by reference by the city in EWMC Title 15, the first of the following named codes shall govern over those following:

1. Building code;

2. Residential code;

3. Mechanical code;

4. Fire code;

5. Plumbing code. (Ord. 04-06 § 6, 2004)

15.06.060 Jurisdiction.

Whenever the International Residential Code shall speak of jurisdiction or city or places where this code shall be effective, said jurisdiction shall be meant to be the city. (Ord. 04-06 § 6, 2004)

15.06.070 Appeal.

A. Whenever the building inspector disapproves an application or refuses to grant a permit applied for, or when it is claimed that the provisions of the residential code do not apply, or that the true intent and meaning of the residential code have been misconstrued or wrongfully interpreted, the applicant may appeal from the decision of the building inspector to the city board of adjustment within 14 calendar days from the issuance of the building inspector’s decision pursuant to Chapter 19.06 EWMC as now exists or as may be hereafter amended.

B. Appeals from the board of adjustment decisions shall be made pursuant to EWMC 19.06.060 by filing a land use petition with the Douglas County superior court within 21 days of issuance of the decision as provided in Chapter 36.70(C) RCW, as now exists or as may be hereafter amended. 15.06.080 Violation – Penalty.

A. Any person who shall violate any of the provisions of the International Residential Code or this chapter or who shall fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, and from which no appeal has been taken, or who shall fail to comply with such order as affirmed or modified by the board of adjustment, or by a court of competent jurisdiction, within the time fixed therein, shall severally and for each such violation and noncompliance, respectively, be guilty of a misdemeanor. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each 10 days that prohibited conditions are maintained shall constitute a separate offense.

B. The instigation of misdemeanor proceedings in accordance with subsection A of this section shall not prevent the city from exercising all available civil remedies to force removal of prohibited conditions. (Ord. 04-06 § 6, 2004)
