3.52.010 Definitions.

The following terms however used or referred to in this chapter shall have the following meanings unless a different meaning is required by the context:

A.    “Commercial unit” means a building or portion thereof designed for or used for business, professional or industrial quarters for separate business, professional or industrial entities.

B.    “Employee” means any individual who, on the first day of each quarter in any calendar year in which any excise tax herein provided for is levied or collected, is employed on a full time basis and who devotes his full time to the performance of the duties of his job or position during the regular full time working hours determined and fixed by his employer for the position or job held and for which the employee received compensation. “Employee” however, does not include a part time employee, who is an individual that devotes only a part of his working time in the performance of the duties of a job or position.

C.    “Housing unit” means a building or portion thereof designed for or used for a resident or living quarters for one or more persons living together or of one family.

D.    “Person” means any individual, firm, partnership, corporation, company, association, joint stock association, school district or political subdivision of the state, fraternal, benevolent, religious or charitable society, club or organization, and includes any trustee, receiver, assignee or other person acting in a similar representative capacity. “Person” shall not be construed to include the United States nor the state. 3.52.020 Establishment.

The public interest, welfare, convenience and necessity require the establishment, maintenance and operation by the city of a transit system for the carrying of passengers within the city. The establishment of such system shall be accomplished by the purchase and/or lease of the necessary rolling stock and other equipment and by the operation of the system with either city personnel or by entering into a contract for the operation and maintenance of the system. In order to acquire and operate the system the city council may arrange for the purchase in the manner required by law of the necessary rolling stock and equipment necessary to establish and operate the transportation system contemplated by this chapter and may likewise provide for the operation thereof by city employees or may enter into a contract or lease for the operation and maintenance of the system. The mayor shall fix the amount of fares payable by passengers and the charges to be made for other transit services, subject to council approval. The mayor shall determine routes, schedules and services to be provided. The mayor and city council, to the extent authorized by law, may enter into agreements with others to provide for the joint operation of a transit system which serves Everett and adjoining areas outside the city. 3.52.030 Cost of operation—Financing.

The cost of purchasing and/or leasing buses and other equipment necessary for the operation of the system and all the cost of the operation of the system and the costs of the replacement thereof shall be financed entirely out of revenue from the operation of the transit system and out of revenues derived from the transit subsidy excise taxes levied and imposed by Chapter 3.50 or derived from state or federal sources or by loans from other city funds which may be made and repaid pursuant to state law out of the transit fund provided for in Chapter 3.50. 3.52.050 Initial loan.

Salaries shall be paid from the transit fund. To meet the initial expenses of the system, including bus acquisition, an amount not to exceed sixty thousand dollars may be borrowed from the general fund, which loan shall be registered and bear interest in the amount of six and one-half percent. (Prior code § 1.92.060)

3.52.060 Advertising unlawful—Exception.

Except as provided in Section 3.52.080, it shall be unlawful to place commercial advertising matter in or upon any vehicle which is the property of the city of Everett. “Advertising,” for the purposes of this section, shall mean any printed matter which attracts the public’s attention for the purpose of stimulating interest in the purchase of goods or services. 3.52.070 Announcement—Review by council.

Except as provided in Section 3.52.080, public announcements may be placed in or upon city vehicles upon the condition that council shall review and approve each announcement and no announcement may be approved which contains advertising as defined herein. 3.52.080 Advertising on buses allowed.

Public announcements and commercial advertising may be placed on transit buses. Revenue generated from allowing public announcements or commercial advertising on transit buses shall be paid into the transit fund. (Ord. 2022-94 § 3, 1994)

*Eligibility in these categories is validated through Everett Transit’s established processes.

B.    Fare Policy.

1.    Paper transfers will not be issued or accepted on Everett Transit fixed-route services.

2.    Transfer of customers will occur between Everett Transit and Community Transit senior and disabled demand response services at no additional cost to the customer so long as there is an interlocal agreement in place to allow such a transfer to complete a one-way trip.

3.    “Freedom fare” is authorized as a promotional fare to encourage use of Everett Transit and its services. “Freedom fare” can be issued at promotional events, transit fairs and other venues, in partnership with other organizations/agencies and/or through direct mailings.

4.    Special Events and Tailored Services Fare.

a.    Prepaid tickets, designated passes, or cash shall be the only fare media accepted for special services.

b.    Special services shall be priced to assure that, over the course of the service, operating costs will be recovered by the fares.

c.    Special services shall not take priority over scheduled fixed route operations.

d.    Special services, once scheduled and advertised, will not be cancelled without due process and notification.

e.    Access to special services shall not be limited to customers for which the service is intended and shall be available to anyone paying the designated fare for the service.

5.    The qualifying age to be designated a senior citizen shall be increased to sixty-five effective January 1, 2007. Persons ages sixty-two through sixty-four as of December 31, 2006, are eligible for the Everett Transit Senior Card if application is made by December 30, 2006.

6.    The following shall be acceptable forms of fare on all Everett Transit services including demand response services: cash, prepaid tickets issued by Everett Transit, Puget Pass, freedom fare and specific service and/or institutional passes.

7.    Subject to Everett Transit’s approved budget, Everett Transit is authorized to implement periodic “fare free” service. This authorization is intended as a tool to encourage ridership on struggling services, to introduce new routes or modifications to existing routes and to assist with traffic mitigation during times when it is desirable to shift travel modes from single occupancy vehicles to public transit.
