PARKING ON RESIDENTIAL PROPERTY

8.60.010 Purpose.
The purpose of this chapter is to restrict the number of motor vehicles that may be parked at a single residential address by declaring the parking of motor vehicles in violation of this chapter to be a public nuisance. (Ord. 3411-14 § 3, 2014: Ord. 2840-05 § 1, 2005)
8.60.020 Definitions.
For the purpose of this chapter, the following terms shall be defined as follows:
A. “Licensed driver” means a person who has obtained a valid Washington State driver’s license. The only exceptions are those expressly allowed by RCW 46.20.025, as now or hereinafter enacted, or a new resident to Washington as defined by RCW 46.20.021, as now or hereinafter enacted.
B. “Operable vehicle” is a motor vehicle which is capable of being operated legally on a public highway and has, in fact, been operated on a public highway in the previous thirty days.
C. “Residential” means those areas of Everett that are zoned R-S, R-S-1, R-1, R-1(A), R-2, R-2(A), R-3, R-4 and R-5, as defined by Title 19, Chapter 1.
D. “Residential address” means any residential parcel or parcels of land that are identified by a single address. In instances where this chapter applies to an address with a duplex or other multiple-family dwelling on the property, the address will be considered a single residential address and not multiple residential addresses, unless the residential address has an approved building and parking plan pursuant to Section 8.60.040(B)(3).
E. “Motor vehicle” has the meaning defined by state law. (Ord. 3411-14 § 4, 2014: Ord. 2840-05 § 2, 2005)
8.60.030 Parking restrictions.
No more than four motor vehicles shall be parked at a single residential address. Each motor vehicle must be currently licensed and operable. (Ord. 3411-14 § 5, 2014: Ord. 2840-05 § 3, 2005)
8.60.040 Exemptions.
A. If more than four licensed drivers reside at the same address, an additional motor vehicle for each licensed driver over four may be parked at that particular address; however, each licensed driver must have that particular address on his or her license.
B. This chapter does not apply to:
1. Motor vehicles parked inside of a lawfully permitted and constructed building;
2. Temporary parking for a duration not to exceed seventy-two hours;
3. A residential address with an approved building and parking plan;

8.60.050 Enforcement procedure.
The enforcement procedure for this chapter shall be the enforcement procedure set out in Everett Municipal Code Chapter 1.20. (Ord. 2840-05 § 5, 2005)
